In accordance with section 70.14 of the Copyright Act, the Copyright Board hereby publishes the statement of proposed roy- alties filed by AVLA Audio-Video Licensing Agency Inc. (AVLA) on April 2, 2013, with respect to royalties it proposes to collect, from the Canadian Broadcasting Corporation (CBC), effective on January 1, 2014, for the reproduction of sound re- cordings, in Canada, in connection with over-the-air radio broad- casting operations, for the years 2014 to 2016.
In accordance with the provisions of the same section, the Board hereby gives notice that prospective users or their represen- tatives who wish to object to the statement may file written ob- jections with the Board, at the address indicated below, within 60 days of the publication hereof, that is no later than June 19, 2013.

Conformément à l’article 70.14 de la Loi sur le droit d’auteur, la Commission du droit d’auteur publie le projet de tarif que la AVLA Audio-Video Licensing Agency Inc. (AVLA) a déposé auprès d’elle le 2 avril 2013, relativement aux redevances qu’elle propose de percevoir de la Société Radio-Canada (SRC), à compter du 1 er janvier 2014, pour la reproduction d’enregistrements sonores, au Canada, dans le cadre des activités de diffusion radio-phonique, pour les années 2014 à 2016.
Conformément aux dispositions du même article, la Commis-sion donne avis, par les présentes, que tout utilisateur éventuel intéressé, ou son représentant, désirant s’opposer à ce projet de tarif doit déposer son opposition auprès de la Commission, par écrit, à l’adresse apparaissant ci-dessous, dans les 60 jours de la présente publication, soit au plus tard le 19 juin 2013.

(AVLA) FOR THE REPRODUCTION OF SOUND RECORDINGS, IN CANADA, IN CONNECTION WITH OVER-THE-AIR RADIO BROADCASTING OPERATIONS, FOR THE YEARS 2014 TO 2016
Short Title 1. This tariff may be cited as the AVLA CBC Radio Tariff, 2014-2016.
Application 2. This tariff sets the royalties to be paid by CBC, in connec- tion with its over-the-air radio broadcasting operations, to repro- duce in Canada published sound recordings in the repertoire of AVLA, including the performers’ performances embodied therein where AVLA administers the rights in those performers’ per- formances on behalf of the makers of, or other rights holders in, the sound recordings in which they are embodied.
3. This tariff does not authorize the use of any reproduction made pursuant to section 2 in association with a product, service, cause or institution.
Royalties 4. CBC shall pay, per month, on the first of each month, $65,000 to AVLA.
5. All royalties are exclusive of any federal, provincial or other governmental taxes or levies of any kind.
Information on Repertoire Use 6. (1) No later than the 14th day of each month, CBC shall pro- vide to AVLA the sequential lists of all musical works, or parts thereof, and published sound recordings embodying musical works, or parts thereof, broadcast by each of CBC’s conventional radio stations, as may be applicable, during the previous month. Each entry shall include the following information:
(a) the date of the broadcast; (b) the time of the broadcast; (c) the type of broadcast (e.g. local, regional); (d) the title of the sound recording; (e) the title of the album; (f) the catalogue number of the album; (g) the track number on the album; (h) the name of the record label; (i) the name of the author and composer; (j) the name of all performers or the performing group; (k) the duration of the sound recording broadcast, in minutes and seconds;
(l) the duration of the sound recording as listed on the album, in minutes and seconds;
(m) the Universal Product Code (UPC) of the album; (n) the International Standard Recording Code (ISRC) of the sound recording;
(o) the type of usage (feature, theme, background, etc.); (p) the name of the program, station (including call letters), and location of the station on which the sound recording was broadcast;

Titre abrégé 1. Tarif radio AVLA-SRC, 2014-2016.
Application 2. Le présent tarif établit les redevances payables par la SRC dans le cadre de ses opérations de radiodiffusion hertzienne, pour la reproduction au Canada d’enregistrements sonores faisant par-tie du répertoire d’AVLA, y compris les prestations d’artistes-interprètes qui font partie dudit répertoire lorsque AVLA administre les droits dans lesdites prestations d’artistes-interprètes au nom des producteurs des enregistrements sonores ou d’autres titulaires de droits dans les enregistrements sonores.
3. Le présent tarif n’autorise pas l’usage d’une reproduction effectuée conformément à l’article 2 en lien avec un produit, un service, une cause ou un établissement.
Redevances 4. La SRC versera à AVLA, le premier jour de chaque mois, des redevances de 65 000 $.
5. Les redevances ne comprennent ni les taxes fédérales, pro-vinciales ou autres, ni les prélèvements d’autre genre qui pourraient s’appliquer.
Information sur l’utilisation du répertoire 6. (1) Au plus tard le quatorzième jour du mois, CBC fournit à AVLA les listes séquentielles de toutes les œuvres musicales, de toutes les parties d’œuvres musicales et de tous les enregistre-ments sonores publiés comportant des œuvres musicales ou des parties d’œuvres musicales diffusés par les stations de radio conventionnelles de la SRC, dans la mesure où le tout est appli-
cable, au cours du mois précédent. Chaque entrée doit contenir les renseignements suivants :
a) la date de la diffusion; b) l’heure de la diffusion; c) le type de diffusion (par exemple locale, régionale); d) le titre de l’enregistrement sonore; e) le titre de l’album; f) le numéro de catalogue de l’album; g) le numéro de piste sur l’album; h) la maison de disque; i) le nom des auteurs et des compositeurs; j) le nom des interprètes ou du groupe d’interprètes;
k) la durée d’exécution de l’enregistrement sonore, en minutes et en secondes;
l) la durée de l’enregistrement sonore précisée sur l’album, en minutes et en secondes;
m) le code-barres (UPC) de l’album;
n) le code international normalisé des enregistrements (CINE) de l’enregistrement sonore;
o) le genre d’utilisation (en vedette, thème sonore, musique d’ambiance, etc.);

(2) The information set out in subsection (1) shall be provided electronically, in Excel format or in any other format agreed upon by AVLA and CBC, with a separate field for each piece of infor- mation required in paragraphs (1)(a) to (r).
Records and Audits 7. (1) CBC shall keep and preserve, for a period of six months after the end of the month to which they relate, records from which the information set out in subsection 6(1) can be readily ascertained.
(2) AVLA may audit these records at any time during the per- iod set out in subsection (1), on reasonable notice and during normal business hours.
(3) AVLA shall, upon receipt, supply a copy of the report of the audit to CBC.
(4) If an audit discloses that royalties due have been under- stated in any month by more than 10 per cent, CBC shall pay the reasonable costs of the audit within 30 days of the demand for such payment.
Confidentiality 8. (1) Subject to subsections (2) and (3), AVLA shall treat in confidence information received pursuant to this tariff, unless CBC consents in writing to the information being treated otherwise.
(2) Information referred to in subsection (1) may be shared (a) with any other collective society in Canada that has secured a certified tariff applicable to CBC;
(b) with the Copyright Board; (c) in connection with proceedings before the Board, if CBC is first given the opportunity to request a confidentiality order;
(d) to the extent required to effect the distribution of royalties, with royalty claimants; or
(e) if ordered by law.
(3) Subsection (1) does not apply to information that is publicly available, or to information obtained from someone other than CBC and who is not under an apparent duty of confidentiality to CBC.
9. (1) If CBC discovers an error in a payment already made to AVLA, CBC shall notify AVLA of the error, and an appropriate adjustment shall be made to the next payment due following the notification. No adjustments to reduce the amount of royalties owed may be made in respect of an error discovered by CBC which occurred more than 12 months prior to its discovery and notification to AVLA.
(2) When an error is discovered by AVLA at any point in time, AVLA shall notify CBC and an appropriate adjustment shall be made to the next payment due following notification.

Registres et vérifications 7. (1) La SRC tient et conserve, durant six mois après la fin du mois auquel ils se rapportent, les registres permettant de vérifier facilement les renseignements détaillés au paragraphe 6(1).
(2) AVLA peut vérifier ces registres à tout moment durant la période visée au paragraphe (1), durant les heures régulières de bureau et moyennant un préavis raisonnable.
(3) Dès qu’elle reçoit un rapport de vérification, AVLA en fait parvenir une copie à la SRC.
(4) Si la vérification révèle que les redevances ont été sous-estimées de plus de 10 pour cent pour un mois quelconque, la SRC en acquitte les coûts raisonnables dans les 30 jours suivant la date à laquelle on lui en fait la demande.
Traitement confidentiel 8. (1) Sous réserve des paragraphes (2) et (3), AVLA garde confidentiels les renseignements qui lui sont transmis en applica-tion du présent tarif, à moins que la SRC ne consente par écrit à ce qu’il en soit autrement.
(2) Les renseignements visés au paragraphe (1) peuvent être partagés :
a) avec une autre société de gestion canadienne ayant fait ho-
mologuer un tarif applicable à la SRC; b) avec la Commission du droit d’auteur; c) dans le cadre d’une affaire portée devant la Commission,
après que la SRC aura eu l’occasion de demander une ordonnance de confidentialité;
d) avec une personne qui demande le versement de redevances, dans la mesure où cela est nécessaire pour effectuer la distribution;
e) si la loi l’oblige. (3) Le paragraphe (1) ne s’applique pas aux renseignements ac-cessibles au public ou obtenus d’un tiers non tenu lui-même de garder ces renseignements confidentiels.
9. (1) Si, après avoir effectué un versement à AVLA selon ce tarif, la SRC découvre une erreur à son sujet, elle doit en aviser AVLA et effectuer les ajustements nécessaires lors de son pro-chain versement. Aucun ajustement visant à réduire le montant de redevances exigibles ne peut être effectué pour une erreur découverte par la SRC qui est survenue plus de 12 mois avant sa dé-couverte et l’avis à AVLA.
(2) Si AVLA découvre une erreur, à quelque moment que ce soit, elle en avise la SRC qui effectuera l’ajustement nécessaire lors du versement suivant immédiatement cet avis.
6 Supplement to the Canada Gazette (3) The 12-month limit in subsection (1) shall not apply to an error discovered by AVLA, including without limitation an error discovered pursuant to subsection (2) or an underpayment discov- ered through an audit conducted pursuant to subsection 8(2).
Interest and Penalties on Late Payments and Reporting 10. (1) In the event that CBC does not pay the amount owed under section 4 or provide the information required by subsec- tion 6(1) by the due date, CBC shall pay to AVLA interest calcu- lated on the amount owed from the due date until the date both the amount and the report are received by AVLA. Interest shall be calculated daily, at a rate equal to one per cent above the Bank Rate effective on the last day of the previous month (as published by the Bank of Canada). Interest shall not compound.
(2) In the event that CBC does not provide the sequential lists required by section 6 by the due date, CBC shall pay to AVLA a late fee of $50.00 per day from the due date until the date the sequential lists are received by AVLA.
Addresses for Notices, etc. 11. (1) Anything addressed to AVLA shall be sent to 85 Mowat Avenue, Toronto, Ontario M6K 3E3, email: radioreproduction@avla.ca, fax number: 416-967-9415, or to any other address, email address or fax number of which CBC has been notified in writing.
(2) Anything addressed to CBC shall be sent to the last address, email address or fax number of which AVLA has been notified in writing.
Delivery of Notices and Payments 12. (1) A notice may be delivered by hand, by postage-paid mail, by email or by fax. A payment must be delivered by hand or by postage-paid mail or by electronic bank transfer. Where pay- ment is made by electronic bank transfer, the reporting required under subsection 6(1) shall be provided concurrently to AVLA by email.
(2) Anything mailed in Canada shall be presumed to have been received four business days after the day it was mailed.
(3) Anything sent by fax or by email shall be presumed to have been received the day it was transmitted.

Intérêts et pénalités relatifs aux paiements tardifs et rapports 10. (1) Si la SRC ne paie pas le montant exigible selon l’arti-cle 4, ou ne fournit pas le rapport prévu au paragraphe 6(1) à l’échéance, elle verse à AVLA un intérêt calculé sur le montant en souffrance à compter de la date d’échéance jusqu’à la date de réception par AVLA du montant exigible et du rapport. L’intérêt est calculé quotidiennement, au taux officiel d’escompte de la Banque du Canada en vigueur le dernier jour du mois précédent (tel qu’il est publié par la Banque du Canada) majoré de un pour cent. L’intérêt n’est pas composé.
(2) Si la SRC ne fournit pas les listes séquentielles exigibles se-lon l’article 6 à l’échéance, elle verse à AVLA des frais de retard de 50,00 $ par jour à compter de la date d’échéance jusqu’à la date de leur réception par AVLA.

Transmission des avis et paiements 12. (1) Un avis peut être livré par messager, par courrier af-franchi, par courriel ou par télécopieur. Un paiement est livré par messager, par courrier affranchi ou par virement bancaire électronique. Dans ce dernier cas, le rapport exigé selon le paragraphe 6(1) est fourni en même temps à AVLA par courriel.
(2) Ce qui est posté au Canada est présumé avoir été reçu qua-tre jours ouvrables après la date de mise à la poste.
(3) Ce qui est envoyé par télécopieur ou par courriel est présumé avoir été reçu le jour de sa transmission.
