Copyright Board Notice of Grounds for Proposed Tariff SOCAN Tariff 2.B – Television – Ontario Educational Communications Authority (2023-2025) December 15, 2021
1. Description of Uses Covered by the Proposed Tariff This tariff applies only to uses of musical works in SOCAN’s repertoire by the Ontario Educational Communications Authority and is limited to communications to the public by telecommunication for its stations, website and technological platforms.
2. Description of Users / Groups of Users Covered by the Proposed Tariff This tariff applies only to the Ontario Educational Communications Authority. 3. Explanation of How Royalties are Determined The proposed annual royalty for each of the years 2023-2025 is as follows: 2023: $420,247.24 2024: $426,108.43 2025: $431,969.62
The proposed rates for 2023-2025 are inflationary increases based on the Board's established inflation adjustment methodology from the previously-approved rate, which has been in place since 2014. There is also a separate increase to account for a change in the "websites and other technological platforms" portion of the rate. This portion of the overall royalty rate was increased from 1.9% to 3.0% to match the proposed Online Audio-Visual Services rate.
4. Submissions on the Collection of Information This tariff does not have any specific reporting requirements. 5. Explanation of Changes from Previously-Approved Tariff There are three changes from the previously-approved tariff: 1. The explanation for the proposed rate for 2023-2025 is found above. 2. The proposed tariff changed the language from “licence to perform” to “licence to communicate to the public by telecommunication” because the reference to “performance” was erroneous.
3. The proposed tariff includes additional language to clarify that the tariff only applies to the Ontario Educational Communications Authority. In accordance with the Board’s Practice Notice on Filing of Proposed Tariffs [PN 2019-004 rev. 1], the tariff wording has been amended to avoid referring to other SOCAN tariffs.
