Copyright Board Notice of Grounds for Proposed Tariff SOCAN Tariff 10.A Parks, Parades, Streets and Other Public Areas - Strolling Musicians and Buskers; Recorded Music

1. Description of Uses Covered by the Proposed Tariff This tariff applies to public performances of musical works in SOCAN’s repertoire by strolling musicians or buskers, or by means of recorded music, in parks, streets or other public areas.

2. Description of Users / Groups of Users Covered by the Proposed Tariff Users are event organizers or hosting municipalities who organize or authorize the public performance of musical works in public spaces by strolling musicians or buskers or by means of recorded music. Users can also be individual strolling musicians or buskers. Some examples of well-known users of this tariff are the Halifax International Busker Festival and the RCMP Musical Ride Branch. Importantly, it is the nature of the use, and not the nature of the user, that determines whether the tariff applies.

3. Explanation of How Royalties are Determined The proposed royalty rate for 2023-2025 is $41.42 per day with a maximum fee of $283.66 in any three-month period. The proposed royalty is an inflationary increase based on the Board's established inflation adjustment methodology from the previously-approved rate, which has been in place since 2015.

4. Submissions on the Collection of Information This tariff does not have any specific reporting requirements. 5. Explanation of Changes from Previously Approved Tariff There are two changes from the previously-approved tariff: 1. The proposed royalty for 2023-2025 is an inflationary increase, as described above. 2. The tariff wording has been amended slightly to clarify that the tariff does not cover concert performances. In accordance with the Board’s Practice Notice on Filing of Proposed Tariffs [PN 2019-004 rev. 1], the tariff wording has been amended to avoid referring to other SOCAN tariffs.
