Mr. McDougall, Re: SOCAN and Re:Sound tariffs This letter constitutes the statement of objections of Restaurants Canada in respect of the following proposed royalties to be collected by SOCAN and Re:Sound for the Performance in Public or the Communication to the Public by Telecommunication, in Canada, of Published Sound Recordings Embodying Musical Works and Performers’ Performances of Such Works for the years 2020 and beyond, as published in the Canada Gazette in May 2019:

Public performance of Musical or Dramatico-musical works (SOCAN):

a. Tariff No. 3.A Live music (in cabarets, clubs, cocktail bars, dining rooms, lounges, restaurants, roadhouses, taverns and similar establishments), b. Tariff No. 3.B Use of Recorded Music Accompanying live entertainment c. Tariff No. 4.A Popular music concerts d. Tariff No. 15.A Background music in establishments not covered by tariff no. 16 e. Tariff No. 18 Recorded music for dancing f. Tariff No. 20 Karaoke bars and similar establishments g. Tariff No. 22.A – Internet online music services

Public Performance of Sound Recordings (Re:Sound) h. Tariff No. 5.A Recorded music to accompany live events i. Tariff No. 5.C Karaoke bars

Restaurants Canada objects to the proposed terms and rates of these tariffs and looks forward to presenting evidence in support of these and any other objections that might arise over the course of the Copyright Board proceeding. We would also bring forward the case against retroaction of payment on some of the tariffs.
