Copyright Board Canada Ottawa, November 4, 1992 FILE 1992-UO/TI-9 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to the Saint-Eustache School Board, Saint-Eustache, Quebec, authorizing the reproduction of a published work Reasons for the Order On October 5th, 1992, the Saint-Eustache School Board from Saint-Eustache, Quebec (hereinafter, "the applicant") filed a licence application with the Board under section 70.7 of the Copyright Act (hereinafter, "the Act") to authorize the reproduction of the 72 pages of a mathematics exercise book book entitled "Ma numérotation de 1 à 9999", by Michel Richard, published by Outils Pédagogiques Inc., in 1981. The applicant wishes to use 14 copies of the book in a fourth grade elementary school mathematics course. One copy would be made for each student. The applicant contends that the copyright owner is unlocatable. The efforts to locate him proved to be in vain. The applicant's representative, Daniel Payette, contacted l'Union des écrivaines et écrivains québécois (UNEQ), the Copyright and Industrial Design Branch of Consumer and Corporate Affairs Canada, the Quebec Department of Education, several universities in Quebec, mathematicians' and teachers' associations, and school book editors. The Board is satisfied that the applicant has made reasonable efforts to locate the copyright owner and that, furthermore, the owner cannot be located. Thus, under subsection 70.7(1) of the Act, the Board is entitled to grant a non-exclusive licence authorizing the applicant to use the work described above. La Commission scolaire voudrait se servir d'exemplaires de ce cahier dans l'enseignement des mathématiques dans une classe de 4e année au niveau primaire. Chaque étudiant recevrait un exemplaire. La demanderesse prétend que le titulaire du droit d'auteur est introuvable. Les efforts effectués pour le retrouver se sont avérés infructueux. Son représentant, Daniel Payette, a communiqué avec l'Union des écrivaines et écrivains québecois (UNEQ), le Bureau du droit d'auteur de Consommation et Affaires commerciales Canada, le ministère de l'Éducation du Québec, plusieurs universités québécoises, associations de mathématiciens et d'enseignants et maisons d'édition pour les ouvrages scolaires. La Commission estime que la demanderesse a fait son possible, dans les circonstances, pour retrouver le titulaire du droit d'auteur et que, par ailleurs, celui-ci est introuvable. Pour ce motif, le paragraphe 70.7(1) de la Loi permet à la Commission d'émettre une licence non exclusive à la demanderesse l'autorisant à utiliser l'oeuvre décrite ci-haut. Conformément au paragraphe 70.7(2), voici les modalités que fixe la Commission:
- 2 A) The expiry date of the licence The licence will expire on December 31, 1992. The applicant is not authorized to make any copies beyond that date. B) The type of use which is authorized The Board authorizes the applicant to reproduce 14 copies of each of the 72 pages of the 1981 edition of "Ma numérotation de 1 à 9999". C) The licence fee The Board finds that the circumstances of this case warrant that the licence fee be set at $25.00. The fee is based on the number of copies to be made, the number of pages to be copied and the use which is authorized by this licence. D) The holding of funds and the disposal of unclaimed funds The Board believes that the "terms and conditions" provision contained in subsection 70.7(2) of the Act allows it to make use of any device that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. Requiring a licensee to pay the royalties directly to a licensing body permits the copyright owner to collect the royalties directly from the licensing body, in this case, UNEQ, just as an owner who is a member of the licensing body would. As for the licensing body, it may acquire a new member, or may be able to keep the royalties fixed in the licence, with the accumulated interest, for the overall benefit of its members, if it does not hear from the copyright owner within five years of the expiration of the licence. La demanderesse n'est pas autorisée à faire de copies au-delà de cette date. B) Le genre d'utilisation autorisée La Commission autorise la demanderesse à reproduire en 14 exemplaires chacune des 72 pages de l'édition de 1981 de «Ma numérotation de 1 à 9999». C) Le coût de la licence La Commission estime approprié de fixer à 25,00$ les droits de licence à payer. La Commission a tenu compte du nombre d'exemplaires autorisé, du nombre de pages qui pourront être reproduites et de l'utilisation qui est permise par cette licence. D) La détention des fonds et la disposition des fonds non réclamés La Commission est d'avis que le pouvoir dont elle dispose en vertu du paragraphe 70.7(2) de la Loi pour fixer les «modalités» de la licence lui permet d'avoir recours à tout moyen permettant de protéger les intérêts des titulaires introuvables de droits d'auteur sans imposer un fardeau démesuré au demandeur. La Commission, en ordonnant à celui ou celle à qui elle délivre une licence de verser les droits fixés par la licence directement à une société de gestion, dans ce cas-ci, l'UNEQ, permet au titulaire du droit d'auteur de recouvrer ces droits en s'adressant directement à la société de gestion. Le titulaire du droit d'auteur pourra ainsi suivre la même procédure pour obtenir compensation que s'il était membre de la société de gestion. Quant à la société de gestion, elle pourra espérer augmenter ses rangs si le titulaire du droit d'auteur se manifeste dans les cinq ans suivant l'expiration de la licence. Sinon, elle conservera le montant des droits fixés par la licence et les intérêts accumulés, dans l'intérêt général de ses membres.
