Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, March 18, 2003 FILE 2002-UO/TI-34 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Louise Fleury-Maltais, Alma, Quebec, for the reproduction of two texts

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board issues a licence to Louise Fleury-Maltais as follows:

(1) The licence authorizes the reproduction and publication, in a poetry anthology entitled A la lueur d'une bougie, of the following two works:

“Pour fêter nos amours,” excerpt from La muse populaire, published in 1921 by C.O. Beauchemin et fils (andantino, L. Collin); and

“Le Noël d'un prisonnier” by François Depret, taken from Cahier des prisonniers, published by Éditions La Baçonnière, Neuchâtel, c. 1940.

No more than 100 copies will be reproduced. The issuance of this licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.

(2) The licence expires on December 31, 2003. Any authorized reproduction must be completed by that date.

(3) The licensee must clearly provide for each of the works reproduced the standard bibliographical reference, namely, the work’s title, author, editor, and the place and date of publication.

(4) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(5) Louise Fleury-Maltais will pay the sum of $45 to the Société québécoise de gestion collective des droits de reproduction (COPIBEC), which may dispose of the amount of

- 2 - royalties set by the licence as it sees fit for the general benefit of its members. COPIBEC undertakes, however, to reimburse any person who establishes, before December 31, 2008, ownership of the copyright in any of the works covered by this licence.

(6) The coming into force of this licence is conditional on COPIBEC filing with the Board the receipt for the amount of royalties set in the licence, accompanied by an undertaking by COPIBEC to comply with the conditions set out in paragraph (5) above.
