Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, February 9, 2005 FILE 2005-UO/TI-04 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Trigenex inc., Ste-Julie, Quebec, authorizing the reproduction of architectural plans

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board issues a licence to Trigenex inc. as follows:

(1) The licences authorizes the reproduction of one copy—for consultation and analysis purposes only—of the architectural plans created by Angelo A. Kolenc in 1977 for the property located at 33 Banner Road in Ottawa, Ontario.

The issuance of this licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.

(2) The licence expires on March 31, 2005. Any authorized reproduction must therefore be completed by that date.

(3) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(4) The applicant will pay the sum of $25 to any person who establishes, before March 31, 2010, ownership of the copyright in the work covered by this licence.

(5) The coming into force of this licence is conditional on the filing with the Board of an undertaking by the applicant to comply with the conditions set out in paragraph (4) above.
