Copyright Board Canada Ottawa, May 6, 1994 FILE 1994-UO/TI-1 UNLOCATABLE COPYRIGHT OWNERS Reasons for the Order On February 8, 1994, McGraw-Hill Ryerson Limited filed a licence application with the Board to authorize the reproduction, in a forthcoming fourth edition of a textbook entitled "The Act of Writing" by Ronald Conrad, of a letter sent by Rita Schindler to the Editor of the Toronto Star and published in the "Have Your Say" column of the December 30, 1990 edition. The textbook will contain approximately 320 pages of text and will sell for about $25.00. Between 1995 and 2000 about 19,500 copies are expected to be printed. The applicant is a publisher established in Whitby, Ontario, specializing in the publication of professional, legal and reference works. In the application and in a sworn statement dated March 22, 1994, Norma J. Christensen, Developmental Director of the College Division of McGraw-Hill Ryerson Limited described the efforts made to locate the copyright owner, Rita Schindler. The letter published in the Toronto Star mentioned only the city from which the letter originated, Scarborough. The Star said that it kept letters to the editor for only six months. Mrs. Christensen contacted the Director of Records at Scarborough General Hospital (Mrs. Schindler's letter refers to the injuries suffered by her son, who had to be taken to Scarborough General). The Director said that information concerning patients is strictly confidential. She contacted all subscribers with the same last name listed in the local telephone book, but no one had ever heard of a Rita Schindler. La demanderesse est une maison d'édition établie à Whitby (Ontario), et se spécialise dans la publication d'ouvrages à caractère professionnel, légal et de référence. Dans la demande, ainsi que dans une déclaration assermentée en date du 22 mars 1994, madame Norma J. Christensen, directrice du développement à la division collégiale et universitaire de McGraw-Hill Ryerson Limited, a décrit les efforts faits afin de retrouver la titulaire du droit, madame Rita Schindler. Le texte publié dans le Toronto Star ne mentionnait que la ville d'origine de la lettre, soit Scarborough. Le Star a indiqué qu'il ne conservait les lettres du courrier du lecteur que pour une période de six mois. Madame Christensen a notamment communiqué avec le directeur des archives à l'hôpital de Scarborough (la lettre de madame Schindler fait état des sévices subis par son fils qui a dû être transporté à l'hôpital de Scarborough) qui a indiqué que les informations concernant les patients sont strictement confidentielles. - 2 Transportation, the Police Public Affairs office, the Credit Bureau and the Census Bureau. This was all to no avail, since no one had any information or, if they did, it was confidential. The Board is satisfied that the applicant has made reasonable efforts in the circumstances to try to trace the copyright owner. Accordingly, the Board is issuing a non-exclusive licence to the applicant authorizing it to use the work described above. Pursuant to subsection 70.7(2), the Board establishes the following terms and conditions: (A) The expiry date of the licence The licence will expire on April 30, 2000. The applicant must therefore complete the new edition authorized by that date. (B) The type of use which is authorized The Board authorizes the applicant to include in no more than 19,500 copies of its textbook the letter sent by Rita Schindler to the Editor of the Toronto Star published in the "Have your Say" column of the December 30, 1990 edition. (C) The licence fee The applicant would have offered a $200.00 fee to the copyright owner if it had been able to locate her. The Board finds this fee fair and reasonable. (D) Holding the funds in trust and the disposal of unclaimed funds The Board is of the view that its power under subsection 70.7(2) of the Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright de madame Rita Schindler. En conséquence, la Commission émet une licence non exclusive à la demanderesse l'autorisant à utiliser l'oeuvre décrite ci-haut. Conformément au paragraphe 70.7(2), voici les modalités que fixe la Commission: A) La date d'expiration de la licence La licence expire le 30 avril 2000. La demanderesse doit donc compléter la réédition autorisée d'ici cette date. B) Le genre d'utilisation autorisée La Commission autorise la demanderesse à incorporer dans au plus 19 500 exemplaires de son manuel, la lettre adressée par madame Rita Schindler au rédacteur en chef du Toronto Star parue dans la section «Have Your Say» de l'édition du 30 décembre 1990 C) Le coût de la licence La demanderesse aurait offert une redevance de 200,00 $ à la titulaire du droit si on avait été en mesure de la retrouver. La Commission estime cette redevance juste et raisonnable. D) La détention des fonds en fiducie et la disposition des fonds non réclamés La Commission est d'avis que le pouvoir dont elle dispose en vertu du paragraphe 70.7(2) de la Loi pour fixer les «modalités» de la licence permet d'avoir recours à tout moyen permettant de protéger les

By ordering the person to whom it issues a licence to pay the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties by addressing herself directly to the licensing body. The copyright owner will thus be able to follow the same procedure as she would if she were a member of the licensing body, rather than having to approach the courts. As for the licensing body, it will be able to count on a new member if the owner appears within five years of the expiry of the licence, if not, it may retain the amount of the royalties established in the licence with accumulated interest, in the general interest of its members. To this effect, the Board orders that the amount provided for by the licence be paid into a trust fund held by CANCOPY. The latter has indicated to the Board that it is ready and able to administer these funds. La titulaire du droit d'auteur pourra ainsi suivre la même procédure pour être compensée que si elle était membre de la société de gestion, plutôt que d'avoir à s'adresser aux tribunaux. Quant à la société de gestion, elle pourra espérer compter sur un nouveau membre si la titulaire se manifeste dans les cinq ans suivant l'expiration de la licence, sinon, elle pourra conserver le montant des droits fixés par la licence et les intérêts accumulés, dans l'intérêt général de ses membres. À cet effet, la Commission ordonne que la somme prévue par la licence soit versée dans un fonds en fiducie, détenu par CANCOPY. Cette dernière a indiqué à la Commission qu'elle est à la fois disposée et en mesure d'administrer ce fonds.
