Copyright Board Commission du droit d’auteur Canada Canada Ottawa, March 31, 1995 FILE: 1995-UO/TI-1 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Virany & Virany, Editing and Publishing, Aylmer, Quebec, authorizing it to reproduce one photograph REASONS FOR THE DECISION On November 30, 1994, Mrs. Margaret Virany of Virany & Virany, Editing and Publishing, filed a licence application with the Board under section 70.7 of the Copyright Act. She wished to reproduce one photograph from the first page of the Sunday Reporter of Aylmer of October 29, 1972 in a book of approximately 72 pages about the history of the Rotary Club of Aylmer-Lucerne, Quebec. This photograph depicts a draw in the Aylmer-Lucerne Rotary Club car raffle. No mention of the photographer is made. The title of the book will be: "Wheel of Service: the First Fifty Years of the Rotary Club in Aylmer, Quebec". Mrs. Virany is the writer and editor of the book. She does that work on behalf of the Club and is paid accordingly. She is also responsible for obtaining authorization from copyright holders to use any pertinent material, this led her to contact the Copyright Board. Ten copies of the work in question will first be printed and distributed free of charge to some members of the Rotary Club. The Club may eventually decide to publish and sell more copies of it (100 at approximately $12 per copy). The book will have an ISBN number and will be in a format ready for commercial printing when Mrs. Virany hands it the Club. Cette demande visait la reproduction, dans un livre d'environ 72 pages sur l'histoire du Club Rotary d'Aylmer-Lucerne (Québec), d'une photographie parue le 29 octobre 1972 sur la page couverture du journal Sunday Reporter d'Aylmer. Cette photographie illustre un tirage de voiture qui a eu lieu lors d'une tombola du Club Rotary d'Aylmer-Lucerne. Aucune mention du photographe n'est faite. Le titre du livre sera : «Wheel of Service: the First Fifty Years of the Rotary Club in Aylmer, Quebec». Madame Virany est la rédactrice et éditrice de ce livre. Elle effectue ce travail pour le compte du Club et est rémunérée en conséquence. Elle a également la responsabilité d'obtenir la permission, pour le compte du Club Rotary, des titulaires des droits pour toute utilisation de leur matériel. C'est la raison de sa démarche auprès de la Commission. L'ouvrage en question, qui sera tiré dans un premier temps à dix exemplaires, sera remis gratuitement à certains membres du Club Rotary. Le Club pourrait par la suite décider d'en faire publier d'autres exemplaires, une centaine à environ 12 $ l'exemplaire, s'il décidait de vendre l'ouvrage. Le livre, qui comprendra un numéro ISBN, sera remis au Club par madame Virany dans un format qui permettra ultérieurement une impression commerciale.
- 2 -Mrs. Virany filed a letter supporting her application in January 1995. She then filed a sworn statement, dated March 28, 1995, outlining the steps she took to try and find the copyright owner. She mentions she first found the photograph in question in an album containing press clippings owned by a member of the Club. The person who took the picture is, to Mrs. Virany's knowledge, most likely a former employee of the Sunday Reporter. Mrs. Virany was also employed by the newspaper from 1978 to 1980, when it went brankrupt. The name has since changed to the "Aylmer Reporter". Mrs. Virany has made every reasonable effort to contact the publisher of the Sunday Reporter, Mr. William (Bill) Cavanagh. She contacted Mr. Cavanagh's sister, Mrs. Margaret Bellefeuille, who stated that her brother could not be located. The Board is satisfied that the applicant has made the reasonable efforts in the circumstances to locate the copyright owner. Thus, the Board grants a non-exclusive licence authorizing the applicant to reproduce the work described above. Pursuant to subsection 70.7(2) of the Copyright Act, the Board establishes the following terms and conditions: A) The expiry date of the licence The licence will expire on December 31, 1996. The authorized reproduction must therefore be completed by that date. B) The type of use authorized The Board authorizes the applicant to reproduce, in no more than 110 copies of its book, the photograph which appeared on the first page of the Sunday Reporter of Aylmer on October 29, 1972. Mention must be made as to the origin of the photograph. Au soutien de sa demande, madame Virany précisait en janvier 1995, ainsi que dans une déclaration assermentée en date du 28 mars 1995, les démarches qu'elle avait entreprises afin de retracer le titulaire du droit sur la photographie. Elle mentionnait entre autres qu'elle avait trouvé ladite photographie dans un album de coupures de journaux appartenant à un des membres du Club. La personne qui a pris la photographie est vraisemblablement, selon madame Virany, un employé du Sunday Reporter. Madame Virany a également été une employée de ce journal entre 1978 et 1980 au moment de sa faillite. Il fut rebaptisé par la suite le «Aylmer Reporter». Madame Virany a fait les démarches nécessaires afin de retracer l'éditeur du journal, monsieur William (Bill) Cavanagh. Elle a, entre autres, communiqué avec la soeur de monsieur Cavanagh, madame Margaret Bellefeuille, qui lui a dit que son frère était introuvable. La Commission estime que la demanderesse a fait tout ce qui était possible, dans les circonstances, pour retracer le titulaire du droit. En conséquence, la Commission émet une licence non exclusive à la demanderesse l'autorisant à reproduire l'œuvre décrite ci-dessus. Conformément au paragraphe 70.7(2) de la Loi sur le droit d'auteur, voici les modalités que fixe la Commission : A) La date d'expiration de la licence La licence expire le 31 décembre 1996. On devra donc procéder à toute reproduction autorisée d'ici cette date. B) Le genre d'utilisation autorisée La Commission autorise la demanderesse à reproduire dans au plus 110 exemplaires de son livre, la photographie parue en page couverture du journal Sunday Reporter d'Aylmer du 29 octobre 1972. Une mention devra être faite de l'origine de la photo.
- 3 C) The licence fee The applicant would have offered a $25 fee to the copyright owner of the photograph if she had been able to locate him. The Board finds this fee fair and reasonable. D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 70.7(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, if the owner does not appear within five years of the expiry of the licence, it may retain the amount of the royalties established in the licence with accumulated interest, in the general interest of its members. Thus, the Board orders that the sum provided for by the licence be paid into a trust fund held by l'Union des écrivaines et écrivains québécois (UNEQ) who has informed the Board that it is ready and able to administer these funds. Le secrétaire de la Commission, Claude Majeau Secretary to the BoardC) Le coût de la licence La demanderesse aurait offert une redevance de 25 $ au titulaire de droit sur la photo si elle avait été en mesure de le retrouver. La Commission estime cette redevance juste et raisonnable. D) La détention des fonds et la disposition des fonds non réclamés La Commission est d'avis que le pouvoir dont elle dispose en vertu du paragraphe 70.7(2) de la Loi sur le droit d'auteur pour fixer les «modalités» de la licence permet d'avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d'auteur introuvables sans imposer un fardeau démesuré à la demanderesse. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d'auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d'auteur pourra ainsi s'adresser à la société de gestion plutôt que d'avoir à s'adresser aux tribunaux. Quant à la société de gestion, elle pourra, dans l'intérêt général de ses membres, conserver le montant des droits fixés par la licence et les intérêts accumulés si le titulaire ne se manifeste pas dans les cinq ans suivant l'expiration de la licence. À cet effet, la Commission ordonne que la somme prévue par la licence soit versée dans un fonds en fiducie, détenu par l'Union des écrivaines et écrivains québécois (UNEQ), qui a indiqué à la Commission qu'elle est à la fois disposée et en mesure d'administer ce fonds.
