Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board issues a licence to Quiet Motion Inc. as follows:

(1) The licence authorizes the reproduction and incorporation of the following two postcards in the documentary film Motel—No Vacancy produced by Quiet Motion Inc.:

a photograph of the Cosy Motel restaurant in Longueuil, Quebec, taken by Sterling Photos of Cornwall, Ontario, year unknown; and

an exterior photograph of Motel Henryville in Henryville, Quebec, published by UNIC of Montréal, Quebec, year unknown.

The cinematographic image of each postcard (inserted full screen) will appear once in the 3-hour documentary (three 1-hour episodes) and last for 15 to 60 minutes.

The licence also authorizes the public performance or communication to the public by telecommunication of the two postcards so incorporated as well as their reproduction on any medium for distribution purposes for private performance, as part of the exploitation of the documentary film.

This licence does not release the licensee from the obligation to obtain permission for any use not covered by this licence.

(2) The licence is for five years and expires on March 31, 2013. (3) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

- 2 - (4) Quiet Motion Inc. will pay $346 ($173/postcard) to the Société de droits d’auteur en arts visuels (SODART), which may dispose of the royalties set by the licence as it sees fit f or the general benefit of its members. SODART undertakes, however, to reimburse any person who establishes, before March 31, 2018, ownership of the copyright in either of the two works covered by this licence.

(5) Quiet Motion Inc. must clearly state the following in the credits of the documentary: “The photograph of the Cosy Motel restaurant in Longueil, Quebec, taken by Sterling Photos of Cornwall, Ontario, and the exterior photograph of Motel Henryville in Henryville, Quebec, published by UNIC of Montréal, Quebec, are used under a licence from the Copyright Board of Canada. If you believe that you own rights in any of these works, please contact the Société de droits d’auteur en arts visuels (SODART) by March 31, 2018.”

(6) The coming into force of this licence is conditional on SODART filing with the Board the receipt for the amount of the licence, accompanied by an undertaking by SODART to comply with the conditions set out in paragraph (4) above.
