Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, July 12, 2007 FILE 2007-UO/TI-25 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to the National Film Board of Canada authorizing the reproduction of two photographs

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board issues a licence to the National Film Board of Canada as follows:

(1) The licence authorizes the reproduction of the following two photographs in the booklet of a DVD box set entitled The Science of Moving Images La science des images animées, bringing together the works of filmmaker Pierre Hébert, which appeared in the book Pierre Hébert, l'homme animé, by Marcel Jean, published by Éditions Les 400 coups in 1996:

a photograph of the musical group Chants et danses du monde inanimé, taken at the Galerie Optica in 1984 or 1985 (photographer unknown); and

a photograph of the musical group Chants et danses du monde inanimé, taken during the performance of Adieu Léonardo at the Montreal Museum of Fine Arts in 1987 (photographer unknown).

The print run of the booklet is limited to 1000 copies. The issuance of this licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.

(2) The licence expires on December 31, 2007. Any authorized reproduction must be completed by that date.

(3) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(4) The National Film Board will pay the sum of $249 ($165 for the photograph taken at the Galerie Optica, which will take up two pages in the booklet, and $84 for the photograph taken at the Montreal Museum of Fine Arts, which will take up half a page in the booklet)

- 2 - to the Société de droits d'auteur en arts visuels (SODART), which may dispose of the amount of the royalties set by the licence as it sees fit for the general benefit of its members. SODART undertakes, however, to reimburse any person who establishes, before December 31, 2012, ownership of the copyright in any of the works covered by this licence.

(5) The coming into force of this licence is conditional on SODART filing with the Board the receipt for the amount of royalties set in the licence, accompanied by SODART’s undertaking to comply with the conditions set out in paragraph (4) above.
