Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board issues a licence to Chenelière Éducation as follows:
(1) The licence authorizes the reproduction of the two following nursery rhymes in the book Il faut cultiver notre jardin d’enfants by Thierry Prieur which will be published by Chenelière Éducation:
• Mes oreilles tombent-elles? (from this website www.momes.net) • Le bourdon dit à la clochette (from this website www.musikiwi.com) No more than 6600 copies will be reproduced. Issuance of this licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.
(2) The licence expires on July 1, 2010. Authorized reproduction must be completed by this date.
(3) The licensee must clearly mention, for each of the works reproduced, the usual bibliographic reference, i.e., the title of the work, the author, the publisher, and the place and date of publication, to the extent that this information is available. The author must also ensure that the work is used in accordance with a licence issued by the Copyright Board of Canada in collaboration with the Société québécoise de gestion collective des droits de reproduction.
(4) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.
- 2 - (5) Chenelière Éducation will pay $32.40 for each work (or a total of $64.80) to the Société québécoise de gestion collective des droits de reproduction (COPIBEC), which may dispose of this amount as it sees fit for the general benefit of its members. COPIBEC undertakes, however, to reimburse any person who establishes, before July 1, 2015, ownership of the copyright in any of the works covered by this licence.
(6) The coming into force of this licence is conditional on SARTEC filing with the Board the receipt for the amount of royalties set in the licence, accompanied by an undertaking by SARTEC to comply with the conditions set out in paragraph (5) above.
