Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board of Canada issues a licence to Carol Cloutier, as follows:
(1) The licence authorizes the reproduction of 362 photographs and record jackets included in the book entitled Le Discographe des années 50-59, to the extent that a permission granted in respect of a work is not valid (see Appendix A) and/or to the extent that the work is not in the public domain (see appendices A and B).
(2) No more than 1,000 copies shall be reproduced. (3) Issuance of this licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.
(4) The licence expires on January 31, 2013 or, in respect of a work, once it enters the public domain.
(5) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.
(6) The licensee must indicate the name of the photographer when identified. (7) The licensee must clearly indicate the following in the book being written: Some works are used under the non-exclusive licence issued by the Copyright Board of Canada. If you believe you have rights in the works reproduced in this book, please contact the Society for Reproduction Rights of Authors, Composers and Publishers in Canada – Visual Arts and Crafts (SODRAC).
- 2 - (8) The licensee will pay the sum of $925 to the Society for Reproduction Rights of Authors, Composers and Publishers in Canada – Visual Arts and Crafts (SODRAC), which may dispose of the amount of the royalties set by the licence as it sees fit for the general benefit of its members. SODRAC undertakes, however, to reimburse any person who establishes, before January 31, 2018, ownership of the copyright in any of the works covered by this licence.
(9) The coming into force of this licence is conditional on SODRAC filing with the Board the receipt for the amount of royalties set in the licence, accompanied by an undertaking by SODRAC to comply with the conditions set out in paragraph (8) above.
