Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, January 31, 2013 FILE 2012-UO/TI-18 UNLOCATABLE COPYRIGHT OWNER Non-exclusive licence issued to the National Film Board of Canada, Saint-Laurent, Quebec, for the reproduction and communication to the public by telecommunication of a photograph in a documentary film

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board of Canada grants a licence to National Film Board of Canada as follows:

(1) The licence authorizes the reproduction and communication to the public by telecommunication on the Internet of a photograph published in the Soleil de Québec on June 21, 1969, incorporated in a documentary entitled “Mai en décembre : Godard en Abitibi”. A licence was issued by the Board for the incorporation of the photograph into the film on March 3, 2000 (1999-UO/TI-25).

The photograph, of which the photographer is unknown, shows a protester (identified as Mr. Dudemaine by the director of the documentary).

The film image of the photograph lasts 3 seconds at most in the 25-minute documentary film.

(2) The licence shall expire when the work enters the public domain. (3) The licence is non-exclusive and valid only in Canada. For any other country, it is the law of that country that applies.

(4) The National Film Board of Canada shall pay the sum of $500 to the Society for reproduction rights of authors, composers and publishers in Canada (SODRAC), which may dispose of the amount as it sees fit for the general benefit of its members. SODRAC undertakes, however, to reimburse any person who, within five years upon expiry of this licence, establishes ownership of the copyright in the work covered by this licence.

- 2 - (5) The coming into force of this licence is conditional on SODRAC filing with the Board a Notice of Receipt of the royalties fixed in the licence, accompanied by its Undertaking to comply with the conditions set out in paragraph (4), above.
