Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, October 7, 2009 FILE 2009-UO/TI-16 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to the National Film Board of Canada, authorizing the reproduction of a text by Agathe Martin-Thériault

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board issues a licence to the National Film Board of Canada, as follows:

(1) The licence authorizes the reproduction of the text Le cinéma direct et ses prolongements by Agathe Martin-Thériault, published in 1972 in the magazine Cinéma Québec. The text will be reproduced in the booklet that accompanies the boxed set tribute to Canadian filmmaker Pierre Perrault, entitled L'œuvre de Pierre Perrault/Film Works.

No more than 1000 copies will be reproduced. Issuance of this licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.

(2) The licence expires on December 31, 2009. Authorized reproduction must be completed by this date.

(3) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(4) The National Film Board of Canada will pay the sum of $115 to the Société québécoise de gestion collective des droits de reproduction (COPIBEC), which may dispose of this amount as it sees fit for the general benefit of its members. COPIBEC undertakes, however, to reimburse any person who establishes, before December 31, 2014, ownership of the copyright in the work covered by this licence.

(5) The coming into force of this licence is conditional on the filing with the Board of COPIBEC undertaking to comply with the conditions set out in paragraph (4) above.
