Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, December 11, 2013 FILE 2012-UO/TI-11 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Régiment de Maisonneuve, Montréal, Quebec, authorizing the reproduction, the republication and the communication to the public by telecommunication of a literary work

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board of Canada grants a licence to Régiment de Maisonneuve, as follows:

(1) The licence authorizes the reproduction, the re-publication and the communication to the public by telecommunication of the literary work written by Gérard Marchand entitled Le Régiment de Maisonneuve vers la victoire, 1944-1945, and published in 1980.

The number of copies shall not exceed 1,000 copies. This includes digital access to the work.

The issuance of the licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.

(2) The licence expires on December 31, 2018. All uses authorized by this licence must therefore be completed by that date.

(3) The licence is non-exclusive and valid only in Canada. For any other country, it is the law of that country that applies.

(4) The licensee shall clearly indicate the bibliographic reference for the work used in accordance with standard conventions: title of the work, author, publisher, place and date of publication.

(5) The licensee shall pay the Société québécoise de gestion collective des droits de reproduction (COPIBEC) an initial sum of $200 for the first 100 copies printed and 5% of the retail sale price of each additional copy or digital access sold or distributed. The additional payments to COPIBEC shall be accompanied by an annual sales report of sales made in the previous 12 months, to be provided between April 1 and April 30 of each year.

- 2 - COPIBEC may dispose of the amount of the royalties fixed by the license as it sees fit for the general benefit of its members. COPIBEC undertakes, however, to reimburse any person who by December 31, 2023, establishes ownership of the copyright in any of the works covered by this licence.

(6) The coming into force of this licence is conditional on COPIBEC filing with the Board a Notice of Receipt of Payment and Undertaking in which it undertakes to comply with the conditions set out in paragraph (5), above.
