Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, August 29, 2011 FILE 2010-UO/TI-20 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to the Collegial Centre for Educational Materials Development (CCEMD), Montréal, Quebec, authorizing the reproduction of a poster created by the Kukryniksy Artists’ Group

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board issues a licence to the Collegial Centre for Educational Materials Development (CCEMD) as follows:

(1) The licence authorizes the reproduction on CD-ROM of a poster in a maximum format of 20 cm by 25 cm (8" by 10"), created by the Kukryniksy Artists’ Group entitled “Let's Annihilate the Kulak's Class”, published by Moscow-Leningrad: Gosudarstvennoe izdatel'stvo in 1930.

(2) No more than 5000 copies will be reproduced. (3) The licence expires on December 31, 2016. The authorized reproduction must be completed by that date.

(4) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(5) The issuance of this licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.

(6) The licensee will pay the sum of $100 to the Society for Reproduction Rights of Authors, Composers and Publishers in Canada Visual Arts and Crafts (SODRAC), which may dispose of the amount of the royalties set by the licence as it sees fit for the general benefit of its members. SODRAC undertakes, however, to reimburse any person who establishes, before December 31, 2021, ownership of the copyright in any of the works covered by this licence.

(7) The Collegial Centre for Educational Materials Development (CCEMD) must clearly indicate the following in the documentary’s credits:

- 2 - “The image entitled ‘Let's Annihilate the Kulak's Class’ created by the Kukryniksy Artists’ Group is used under a licence issued by the Copyright Board of Canada. If you believe you have rights in the works reproduced in this book, please contact the Society for Reproduction Rights of Authors, Composers and Publishers in Canada Visual Arts and Crafts (SODRAC).”

(8) The coming into force of this licence is conditional on SODRAC filing with the Board the receipt for the amount of royalties set in the licence, accompanied by an undertaking by SODRAC to comply with the conditions set out in paragraph (6) above.
