Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board of Canada issues a licence to the Bibliothèque et Archives nationales du Québec.
(1) The licence authorizes the reproduction of 40 posters, 6 periodicals and 2 monographs (see Appendix A for the list of works) as well as their communication to the public by telecommunication (see Appendix B for the specific uses authorized).
(2) The issuance of this licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.
(3) The licence expires in respect of a work once it enters the public domain. (4) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.
(5) The licensee will pay the sum $1 per work for the posters (40) and monographs (2), and $25 per periodical (6) to any person who establishes ownership of the copyright of one or more of the works covered by this licence.
(6) The copyright owner may terminate this licence by providing BAnQ with written notice to that effect. BAnQ will cease its use of the works authorized by this licence within 30 days of receipt of this notice. The copyright owner who terminates the licence will nonetheless be entitled to the royalties set out in paragraph (5) above.
(7) The coming into force of this licence is conditional on BAnQ filing with the Board an undertaking to comply with the conditions set out in paragraph (5)
