Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board of Canada grants a licence to Les Productions Flow, as follows:
(1) The licence authorizes the reproduction, synchronization and communication to the public by telecommunication of eight excerpts from videos published on YouTube in a documentary entitled “Police sous surveillance”:
1. “Citoyens non coopératifs” (unknown); 2. “Policier québécois contre jeune black, bavure?” (jememetsbien); 3. “Arrestations par la SQ de Valleyfield” (MrLudo7601); 4. “SPVM Police de Montréal une intervention qui finit bien” (Serge Dallaire); 5. “Arrestation musclée inutile sur le boul. St-Laurent durant la foire commerciale” (Éric Faille);
6. “Un agent de police du SPVM abuse de son poivre Constable 728” (Michael Plourde);
7. “Agent de police du SPVM qui abuse de son poivre Matricule 728” (Michael Plourde);
8. “Matricule 728 SPVM – Stéfanie Trudeau en pleine action – Poivre - Été 2012 Montréal” (unknown).
(2) The licence is valid from November 1, 2015, to October 31, 2020.
- 2 - (3) The licence is non-exclusive and valid only in Canada. For any other country, it is the law of that country that applies.
(4) The licensee shall pay the sum of $200 (or $25/work) to the Producers Audio Visual Collective (PACC), which may dispose of the amount of the royalties fixed by the licence as it sees fit for the general benefit of its members. PACC undertakes, however, to reimburse any person who, by October 31, 2025, establishes ownership of the copyright in any of the work covered by this licence.
(5) The coming into force of this licence is conditional on PACC filing with the Board a Notice of Receipt of Payment and Undertaking in which it undertakes to comply with the conditions set out in paragraph (4), above.
