Copyright Board Canada Ottawa, November 29, 1996 FILE: 1996-UO/TI-7 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Les Distributions Rozon inc. authorizing the use of excerpts of texts written by Raymond Guérin REASONS FOR THE DECISION On September 18, 1996, Ms. Gysèle Barry, on behalf of Les Distributions Rozon inc., filed a licence application with the Board under section 70.7 of the Copyright Act, to use two excerpts (total duration: five seconds) of a television program entitled Les zéros de conduite, written by Raymond Guérin and produced and broadcasted by the Canadian Broadcasting Corporation (CBC) on May 9, 1963. These excerpts will be used in one television program of the series Juste pour rire, to be broadcasted by the CBC, which will highlight, amongst others, the career of Mr. Denis Drouin. Each program of the series lasts one hour and will be broadcasted twice on the CBC over a period of ten months starting October 27, 1996. On August 1, 1996, the Board issued a non exclusive licence to Les Films Rozon inc. authorizing the use of excerpts of texts of variety shows co-written by Messrs. Raymond Guérin and Émilien Labelle which were produced and broadcasted by the CBC in 1956 and 1963. In its reasons for the decision dated August 20, 1996, the Board was satisfied that the applicant had made reasonable efforts, in the circumstances, to locate the copyright owners. The Board applied the same reasons in the case at hand since the copyright owner, in this case Mr. Raymond Guérin, is the same for whom a licence was delivered earlier. Cette demande vise l’utilisation de deux extraits d’archives, pour une durée totale de cinq secondes, provenant de l’émission Les zéros de conduite du 9 mai 1963, produite et diffusée par la Société Radio-Canada (SRC) et dont l’auteur est monsieur Raymond Guérin. Ces extraits seront intégrés à une émission de la série Juste pour rire qui sera diffusée sur les ondes de la SRC, illustrant, entre autres, la carrière de monsieur Denis Drouin. Les émissions de l’ensemble de la série sont d’une heure chacune et seront diffusées à deux reprises sur les ondes de la SRC à compter du 27 octobre 1996 sur une période de dix mois. La Commission a déjà émis le 1 er août 1996 une licence non exclusive aux Films Rozon inc. autorisant l’utilisation d’extraits de textes co-écrits par messieurs Raymond Guérin et Émilien Labelle d’émissions de variétés produites et diffusées par la SRC en 1956 et 1963. Dans ses motifs de décision datés du 20 août 1996, la Commission a estimé que la demanderesse avait fait tout ce qui était possible, dans les circonstances, pour retracer les titulaires de droits. La Commission a appliqué les mêmes motifs à la présente requête étant donné que le titulaire de droit, en l’occurrence monsieur Raymond Guérin, est le même que celui pour lequel une licence fut émise en août dernier. En conséquence, la

Pursuant to subsection 70.7(2) of the Copyright Act, the Board established the following terms and conditions: A) The expiry date of the licence The licence will expire on December 30, 1996. The authorized use must therefore be completed by that date. B) The type of use authorized The Board authorizes the applicant to use the two excerpts (total duration: five seconds) of the program entitled Les zéros de conduite produced and broadcasted by the CBC on May 9, 1963. C) The licence fee After consulting SARDeC, and based on the initial contract of the author with the CBC, the Board finds it appropriate that the licence fee be set at $400. D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 70.7(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, if the owner does not appear within five years of the expiry of the licence, it may retain the amount of the royalties established in the licence with accumulated interest, in the general interest of its members. Conformément au paragraphe 70.7(2) de la Loi sur le droit d’auteur, voici les modalités qu’a fixées la Commission : A) La date d’expiration de la licence La licence expire le 30 décembre 1996. On devra donc procéder à l’utilisation autorisée d’ici cette date. B) Le genre d’utilisation autorisée La Commission autorise la demanderesse à utiliser les deux extraits (d’une durée totale de cinq secondes) de l’émission intitulée Les zéros de conduite produite et diffusée par la SRC le 9 mai 1963. C) Le coût de la licence Après consultation auprès de la SARDeC, et en se basant sur le contrat initial de l’auteur avec la SRC, la Commission estime approprié de fixer les droits de licence à 400 $. D) La détention des fonds et la disposition des fonds non réclamés La Commission est d’avis que le pouvoir dont elle dispose en vertu du paragraphe 70.7(2) de la Loi sur le droit d’auteur pour fixer les «modalités» de la licence permet d’avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d’auteur introuvables sans imposer un fardeau démesuré au demandeur. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d’auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d’auteur pourra ainsi s’adresser à la société de gestion plutôt que d’avoir à s’adresser aux tribunaux. Quant à la société de gestion, elle pourra, dans l’intérêt général de ses membres, conserver le montant des droits fixés par la licence et les intérêts accumulés si le titulaire ne se manifeste pas dans les cinq ans suivant l’expiration de la licence.
- 3 Thus, the Board orders that the sum provided for by the licence be paid into a trust fund held by SARDeC, who has informed the Board that it is ready and able to administer these funds.
