Copyright Board Commission du droit d’auteur Canada Canada Ottawa, June 23, 2014 FILES: 2013-UO/TI-22 and 2014-UO/TI-01 UNLOCATABLE COPYRIGHT OWNER Non-exclusive licence issued to NYM Ministries, Dryden, Ontario, authorizing the public performance, the reproduction and the synchronization of two musical works

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board grants a licence to NYM Ministries as follows:

(1) The licence authorizes the reproduction and synchronization of two musical works entitled Ruby, performed by the Megli Sisters and recorded at American Artists Studios (author, composer and publisher are unknown), in the event that it is protected by copyright and Child's Request, written by William L. Carter and published by Tennessee Music. The licence also authorizes the public performance of the musical works during the workshop that is to be incorporated on a DVD.

No more than 100 copies of the DVD shall be made. (2) The licence expires December 31, 2019. The authorized reproduction must therefore be completed by that date.

(3) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of the country that applies.

(4) The issuance of the licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.

(5) The licensee will pay the sum of $85 per work to the Society for the Reproduction Rights of Authors, Composers and Publishers in Canada (SODRAC). SODRAC will dispose of the amount as it sees fit for the general benefit of its members. SODRAC undertakes however, to reimburse the amount to any person who establishes, before December 31, 2024, ownership of copyright of the works covered by this licence.

(6) The coming into force of this licence is conditional on the filing with the Board of the Notice of Receipt of Payment and Undertaking from SODRAC for the amount of the

- 2 - royalties specified in the licence, accompanied by SODRAC's undertaking to comply with the conditions set out in paragraph (5) above.
