Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board grants a licence to Bryan Reingold as follows:

(1) The licence authorizes the reproduction and the communication to the public by telecommunication, for non-commercial purposes, of a photograph (photographer unknown) representing a building and a sign "Ports of Call", which was the restaurant and bar complex originally located at 1145 Yonge Street, Toronto, Ontario (the original building no longer exists). The photograph is located on the front of a postcard.

The licence is limited to the reproduction of the photography found on the front of the postcard. Therefore, the licensee is not exempt from obtaining a licence for other rights which may be protected by copyright such as the rights pertaining to the architectural work itself, to the extent that the work is protected by copyright.

(2) The licence expires when the work is no longer protected by copyright. (3) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(4) The licensee will pay the sum of $25 to any person who establishes, within five years of the expiry of the licence, ownership of the copyright of the works covered in this licence.

(5) The coming into force of this licence is conditional on the licensee filing with the Board an Undertaking to comply with the conditions set out in paragraph (4) above.
