Copyright Board Commission du droit d’auteur Canada Canada Ottawa, July 28, 1997 FILE: 1997-UO/TI-4 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Éditions d’Acadie, Moncton, N.B., authorizing the reproduction of three photographs taken by Henri Paul REASONS FOR THE DECISION In January and February of 1997, Ms. Gracia Couturier, on behalf of Éditions d’Acadie, filed a licence application with the Board under section 70.7 of the Copyright Act, to reproduce, in a textbook entitled Intermède, three photographs taken by Henri Paul in 1962-63. These photographs served at the time in the advertisement of a theatrical play entitled Piège pour un homme seul presented at the Théâtre du Nouveau Monde in Montreal. The textbook will be used to teach French in New Brunswick at the Grade 11 school level. It will have approximately 400 pages and 10,000 copies will be printed. It will sell at the unit cost of $49.95. In the application, Ms. Couturier described the efforts made to locate the copyright owner. The applicant communicated with the Théâtre du Nouveau Monde, from whom the photographs had been obtained. TNM had no information on the photographer. The applicant also communicated with Mr. André Le Coz, famous photographer in the theatrical circle of Montreal, who informed her that Henri Paul had passed away 25 years ago and that he did not know the descendants. Subsequently, the applicant communicated, amongst others, with the Canadian Association of Photographers & Illustrators, the Corporation des maîtres photographes du Québec and Vis*Art Copyright Inc. All of this research was unsuccessful. The Board was satisfied that the applicant made the reasonable efforts, in the circumstances, to locate the copyright owner. Ces photographies ont servi à l’époque à la publicité de la pièce de théâtre Piège pour un homme seul présentée au Théâtre du Nouveau Monde de Montréal. L’ouvrage, destiné à l’enseignement du français au Nouveau-Brunswick au niveau de la 11 e année, sera tiré à 10 000 exemplaires comportant environ 400 pages. Le prix de vente sera de 49,95 $. Dans la demande, madame Couturier a décrit les efforts faits afin de retrouver le titulaire de droits. La requérante a communiqué avec le Théâtre du Nouveau Monde, d’où les photos ont été obtenues. Le TNM n’a aucune coordonnée au sujet du photographe. Elle a aussi communiqué avec M. André Le Coz, célèbre photographe du milieu théâtral montréalais, qui l’a informée du décès de Henri Paul, il y a 25 ans, et qu’il ne connaissait pas les descendants. Par la suite, la requérante a communiqué, entre autres, avec l’Association canadienne des photographes et illustrateurs, la Corporation des maîtres photographes du Québec et Vis*Art Droit d’Auteur Inc. Toutes ces recherches sont demeurées infructueuses. La Commission a estimé que la requérante avait fait ce qui était possible, dans les circonstances, pour retracer le titulaire de droit. En conséquence, la
- 2 May 13, 1997 a non-exclusive licence authorizing the applicant to reproduce the works described above. Pursuant to subsection 70.7(2) of the Copyright Act, the Board establishes the following terms and conditions: A) The expiry date of the licence The licence will expire on December 31, 1997. The authorized reproduction must therefore be completed by that date. B) The type of use authorized The Board authorizes the applicant to reproduce, in no more than 10,000 copies of the textbook, the works described above. C) The licence fee After consulting Vis*Art Copyright Inc., the Board finds it appropriate that the licence fee be set at $317.40. D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 70.7(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, it may dispose of the amount of the royalties established in the licence as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before December 31, 2002, ownership of the copyright of the work covered by this licence. Conformément au paragraphe 70.7(2) de la Loi sur le droit d’auteur, voici les modalités établies par la Commission : A) La date d’expiration de la licence La licence expire le 31 décembre 1997. On devra donc procéder à la reproduction autorisée d’ici cette date. B) Le genre d’utilisation autorisée La Commission autorise la requérante à reproduire dans au plus 10 000 exemplaires du manuel pédagogique, les œuvres décrites ci-dessus. C) Le coût de la licence Après consultation auprès de Vis*Art Droit d’Auteur Inc., la Commission estime approprié de fixer les droits de licence à payer à 317,40 $. D) La détention des fonds et la disposition des fonds non réclamés La Commission est d’avis que le pouvoir dont elle dispose en vertu du paragraphe 70.7(2) de la Loi sur le droit d’auteur pour fixer les «modalités» de la licence permet d’avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d’auteur introuvables sans imposer un fardeau démesuré au demandeur. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d’auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d’auteur pourra ainsi s’adresser à la société de gestion plutôt que d’avoir à s’adresser aux tribunaux. Quant à la société de gestion, elle peut disposer du montant des droits fixés par la licence comme bon lui semble pour le bénéfice général de ses membres. Elle s’engage toutefois à rembourser toute personne qui établirait, avant le 31 décembre 2002, qu’elle détient le droit d’auteur sur les œuvres faisant l’objet de la présente licence.
