Copyright Board Commission du droit d’auteur Canada Canada Ottawa, August 26, 1997 FILE: 1997-UO/TI-14 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Éditions CEC, Anjou, Quebec, authorizing the reproduction of three excerpts of a text by Alain Serres and Yan Thomas REASONS FOR THE DECISION On July 10, 1997, Ms. Suzanne Berthiaume, on behalf of Éditions CEC, filed a licence application with the Board under section 70.7 of the Copyright Act, to reproduce, in a textbook entitled “Mes ateliers de grammaire”, three excerpts of the text entitled Pourquoi un âne écrivit des livres pour les enfants? written by Alain Serres and Yan Thomas, published by Éditions Messidor/La Farandole in 1992. The textbook, to be used to teach French at the Secondary I school level, will have approximately 300 pages and 10,000 copies will be printed. It will sell at the unit cost of $14.95. On July 2, 1996 the Board issued a non-exclusive licence to Éditions CEC authorizing the reproduction of the same text in another book. In its reasons for the decision, the Board was satisfied that the applicant had made all of the reasonable efforts, in the circumstances, to locate the copyright owners. The circumstances have not changed since. Consequently, the Board grants a non-exclusive licence authorizing the applicant to reproduce the excerpts of the work described above. Pursuant to subsection 70.7(2) of the Copyright Act, the Board establishes the following terms and conditions: A) The expiry date of the licence The licence will expire on December 31, 1997. The authorized reproduction must therefore be completed by that date. Cette demande vise la reproduction, dans un manuel scolaire intitulé «Mes ateliers de grammaire», de trois extraits du texte intitulé «Pourquoi un âne écrivit des livres pour les enfants?» de Alain Serres et Yan Thomas, publié par les Éditions Messidor/La Farandole en 1992. Cet ouvrage, destiné à l’enseignement du français au niveau du secondaire I, sera tiré à 10 000 exemplaires comportant environ 300 pages. Le prix de vente sera de 14,95 $ l’unité. La Commission a déjà émis le 2 juillet 1996 une licence non exclusive aux Éditions CEC autorisant la reproduction du texte en question dans un autre ouvrage. Dans ses motifs de décision, la Commission a estimé que la requérante avait fait tout ce qui était possible, dans les circonstances, pour retracer les titulaires de droits. Les circonstances n’ont pas changé depuis. En conséquence, la Commission émet une licence non exclusive à la requérante l’autorisant à reproduire les extraits de l’œuvre décrite ci-dessus. Conformément au paragraphe 70.7(2) de la Loi sur le droit d’auteur, voici les modalités que fixe la Commission : A) La date d’expiration de la licence La licence expire le 31 décembre 1997. On devra donc procéder à la reproduction autorisée d’ici cette date.
- 2 B) The type of use authorized The Board authorizes the applicant to reproduce, in no more than 10,000 copies of the textbook, the excerpts of the work described above. C) The licence fee After consulting l’Union des écrivaines et écrivains québécois (UNEQ), the Board finds it appropriate that the licence fee be set at $49.83. D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 70.7(2) of the Copyright Act to establish the “terms and conditions” of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, it may dispose of the amount of the royalties established in the licence as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before December 31, 2002, ownership of the copyright of the work covered by this licence. Thus, the Board orders that the sum provided for by the licence be paid to UNEQ. C) Le coût de la licence Après consultation auprès de l’Union des écrivaines et écrivains québécois (UNEQ), la Commission estime approprié de fixer à 49,83 $ les droits de licence à payer. D) La détention des fonds et la disposition des fonds non réclamés La Commission est d’avis que le pouvoir dont elle dispose en vertu du paragraphe 70.7(2) de la Loi sur le droit d’auteur pour fixer les «modalités» de la licence permet d’avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d’auteur introuvables sans imposer un fardeau démesuré au demandeur. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d’auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d’auteur pourra ainsi s’adresser à la société de gestion plutôt que d’avoir à s’adresser aux tribunaux. Quant à la société de gestion, elle peut disposer du montant des droits fixés par la licence comme bon lui semble pour le bénéfice général de ses membres. Elle s’engage toutefois à rembourser toute personne qui établirait, avant le 31 décembre 2002, qu’elle détient le droit d’auteur sur l’œuvre faisant l’objet de la présente licence. À cet effet, la Commission ordonne que la somme prévue par la licence soit versée à l’UNEQ.
