Copyright Board Canada Ottawa, December 11, 1996 FILE: 1996-UO/TI-8 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to the Manitoba Education and Training, Independent Study Program, authorizing the reproduction of extracts of a book REASONS FOR THE DECISION On October 4, 1996, Mr. Mark Gavard, Coordinator, Independent Study Program, Manitoba Education and Training, filed a licence application with the Board under section 70.7 of the Copyright Act, to reproduce portions (approximately 90 pages) of the 200-page book entitled The Technology Connection: The Impact of Technology on Canada, co-written by Dwight Botting, Dennis Gerrard and Ken Osborne and published in 1980 by CommCept Publishing Limited, Vancouver, B.C. One hundred copies will be printed and be used as support material for a Grade 9 Social Studies course for distance education students. In the application and in a sworn statement dated November 20, 1996, Mr. Gavard described the efforts made to locate the copyright owner. He contacted two of the three co-authors, who informed him that they relinquished copyright ownership to Project Canada West (defunct years ago). He also attempted to contact the publisher but discovered that it no longer exists. Finally, he turned to the Canadian Copyright Licensing Agency (CANCOPY) but no result was obtained after research. Mark Gavard, coordonnateur, Independent Study Program, Manitoba Education and Training, déposait auprès de la Commission une demande de licence en vertu de l’article 70.7 de la Loi sur le droit d’auteur. Cette demande vise la reproduction de certaines parties (environ 90 pages) d’un livre de 200 pages intitulé «The Technology Connection: The Impact of Technology on Canada», co-écrit par Dwight Botting, Dennis Gerrard et Ken Osborne, publié en 1980 par CommCept Publishing Limited de Vancouver, C.-B. Cent copies seront reproduites et serviront de matériel de soutien pour un cours de 9 e année en sciences humaines pour les étudiants en formation à distance. Dans la demande, ainsi que dans la déclaration assermentée en date du 20 novembre 1996, M. Gavard a décrit les efforts afin de retrouver le titulaire de droits. Il a communiqué avec deux des trois co-auteurs qui l’ont informé qu’ils avaient cédé les droits à Project Canada West (organisme dissous depuis plusieurs années). Il a aussi tenté de rejoindre l’éditeur, pour découvrir que celui-ci n’existe plus. En dernier recours, il a fait appel à la Canadian Copyright Licensing Agency (CANCOPY), mais leurs recherches n’ont donné aucun résultat.
- 2 The Board was satisfied that the applicant made reasonable efforts to locate the copyright owner. Thus, the Board granted on November 14, 1996, a non-exclusive licence authorizing the applicant to reproduce the extracts described above. Pursuant to subsection 70.7(2) of the Copyright Act, the Board established the following terms and conditions: A) The expiry date of the licence The licence will expire on December 31, 1996. The authorized reproduction must therefore be completed by that date. B) The type of use which is authorized The Board authorizes the applicant to reproduce no more than 100 copies of approximately 90 pages of the book described above. C) The licence fee After consulting the Canadian Copyright Licensing Agency (CANCOPY), the Board finds it appropriate that the licence fee be set at $460. D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 70.7(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, if the owner does not appear within five years of the expiry of the licence, it may retain the amount of the royalties established in the licence with accumulated interest, in the general interest of its members. La Commission a estimé que le requérant a fait son possible, dans les circonstances, pour retracer le titulaire de droits. En conséquence, la Commission a émis le 14 novembre 1996, une licence non exclusive au requérant l’autorisant à reproduire les extraits décrits ci-dessus. Conformément au paragraphe 70.7(2) de la Loi sur le droit d’auteur, voici les modalités qu’a établies la Commission : A) La date d’expiration de la licence La licence expire le 31 décembre 1996. On devra donc procéder à toute reproduction autorisée d’ici cette date. B) Le genre d’utilisation autorisée La Commission autorise le requérant à reproduire au plus 100 copies d’environ 90 pages du livre décrit ci-dessus. C) Le coût de la licence Après consultation auprès de la Canadian Copyright Licensing Agency (CANCOPY), la Commission estime approprié de fixer à 460 $ les droits de licence à payer. D) La détention des fonds et la disposition des fonds non réclamés La Commission est d’avis que le pouvoir dont elle dispose en vertu du paragraphe 70.7(2) de la Loi sur le droit d’auteur pour établir les «modalités» de la licence permet d’avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d’auteur introuvables sans imposer un fardeau démesuré au requérant. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d’auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d’auteur pourra ainsi s’adresser à la société de gestion plutôt que d’avoir à s’adresser aux tribunaux. Quant à la société de gestion, elle pourra, dans l’intérêt général de ses membres, conserver le montant des droits fixés par la licence et les intérêts accumulés si le titulaire ne se manifeste pas dans les cinq ans suivant l’expiration de la licence.
- 3 Thus, the Board orders that the sum provided for by the licence be paid into a trust fund held by the Canadian Copyright Licensing Agency (CANCOPY) who has informed the Board that it is ready and able to administer these funds.
