Copyright Board Canada Ottawa, March 13, 1998 FILE: 1997-UO/TI-15 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to the National Film Board, authorizing the reproduction and incorporation of two photographs (with titles) in a documentary film REASONS FOR THE DECISION In July and December 1997, Ms. Aurore Thériault and Ms. Nicole Charlebois of the National Film Board, Moncton, N.B., filed a licence application with the Board under subsection 77(1) of the Copyright Act, to reproduce two photographs (with titles) of Mathilda Blanchard, famous trade unionist, for incorporation in a documentary film. One photograph was published in the January 19, 1972 issue of the Bathurst Tribune and the other one in the October 25, 1972 issue of Tribune Chaleur. The applicant wants to incorporate the photographs in the documentary film entitled “Mathilda”. The cinematographic image of the photographs will last no more than 3 seconds in the 52 minutes documentary film. In the application, Ms.Thériault and Ms. Charlebois described the efforts made to locate the copyright owners. Both the Bathurst Tribune and Tribune Chaleur newspapers are defunct. The Commission du droit d’auteur Canada Ottawa, le 13 mars 1998 DOSSIER : 1997-UO/TI-15 TITULAIRES DE DROITS D’AUTEUR INTROUVABLES Licence non exclusive délivrée à l’Office national du film, autorisant la reproduction et l’incorporation de deux photographies (avec titres) dans un film documentaire MOTIFS DE LA DÉCISION En juillet et décembre 1997, mesdames Aurore Thériault et Nicole Charlebois de l’Office national du film, Moncton (N.-B.) déposaient auprès de la Commission une demande de licence en vertu du paragraphe 77(1) de la Loi sur le droit d’auteur. Cette demande visait la reproduction et l’incorporation de deux photographies (avec titres) de Mathilda Blanchard, syndicaliste de renom, dans un film documentaire. Une photographie a été publiée dans l’édition du 19 janvier 1972 du Bathurst Tribune et l’autre dans l’édition du 25 octobre 1972 du Tribune Chaleur. La requérante veut incorporer ces photographies dans un film documentaire intitulé «Mathilda». L’image cinématographique des photographies durera au plus 3 secondes dans le film documentaire de 52 minutes. Dans la demande, mesdames Thériault et Charlebois ont décrit les efforts faits afin de retrouver les titulaires de droits. Le Bathurst Tribune et le Tribune Chaleur sont maintenant dissous. - 2 National Film Board therefore communicated with the Director of the Campbellton Tribune and the Director of the Bathurst Northern Light to see if they knew who had bought the newspapers in question. Neither of them had ever heard of the Bathurst Tribune or Tribune Chaleur. The applicant then undertook a research in the New Brunswick Newspaper Directory for the years 1783-1988. Very limited information was found on the two newspapers in question and no details were made available on the owners. The Board was satisfied that the applicant made the reasonable efforts, in the circumstances, to locate the copyright owners. Thus, the Board granted on January 29, 1998 a non-exclusive licence authorizing the applicant to reproduce and incorporate the works described above. Pursuant to subsection 77(2) of the Copyright Act, the Board established the following terms and conditions: A) The expiry date of the licence The licence is for a period of five years and expires on January 29, 2003. B) The type of use authorized The Board authorizes the applicant to reproduce and incorporate the two photographs (and titles) described above. It also authorizes the public performance or the communication to the public by telecommunication of the photographs (and titles) so incorporated, as part of the exploitation of the documentary film. C) The licence fee Since there are no collective society in Canada in the field of audio-visual, the du film a donc communiqué avec les directeurs du Bathurst Northern Light et du Campbellton Tribune afin de savoir qui avait acheté les journaux en question. En conséquence, la Commission a délivré le 29 janvier 1998 une licence non exclusive à la requérante l’autorisant à reproduire et incorporer les œuvres décrites ci-dessus. Conformément au paragraphe 77(2) de la Loi sur le droit d’auteur, voici les modalités établies par la Commission : A) La date d’expiration de la licence La licence est pour une période de cinq ans et expire le 29 janvier 2003. B) Le genre d’utilisation autorisée La Commission autorise la requérante à reproduire et incorporer les deux photographies (avec titres) décrites ci-dessus. Elle autorise aussi l’exécution en public ou la communication au public par télécommunication des photographies (et titres) ainsi incorporées, comme partie de l’exploitation du film documentaire. C) Le coût de la licence Puisqu’il n’existe aucune société de gestion au Canada dans le domaine de l’audio-

D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 77(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, it may dispose of the amount of the royalties established in the license as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before January 29, 2008, ownership of the copyright of the works covered by this licence. Thus, the Board orders that the sum provided for by the licence be paid to Vis*Art Copyright Inc. Le secrétaire de la Commission, Claude Majeau Secretary to the Boardvisuel, la Commission a consulté Vis*Art Droit d’auteur inc. qui a proposé un taux de 368 $/l’œuvre, soit un total de 736 $. La Commission estime approprié de fixer à 736 $ les droits de licence à payer. D) La détention des fonds et la disposition des fonds non réclamés La Commission est d’avis que le pouvoir dont elle dispose en vertu du paragraphe 77(2) de la Loi sur le droit d’auteur pour établir les «modalités» de la licence permet d’avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d’auteur introuvables sans imposer un fardeau démesuré au requérant. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d’auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d’auteur pourra ainsi s’adresser à la société de gestion plutôt que d’avoir à s’adresser aux tribunaux. Quant à la société de gestion, elle peut disposer du montant des droits fixés par la licence comme bon lui semble pour le bénéfice général de ses membres. Elle s’engage toutefois à rembourser toute personne qui établirait, avant le 29 janvier 2008, qu’elle détient le droit d’auteur sur les œuvres faisant l’objet de la présente licence. À cet effet, la Commission ordonne que la somme prévue par la licence soit versée à Vis*Art Droit d’auteur inc.
