Copyright Board Commission du droit d’auteur Canada Canada Ottawa, January 12, 1998 FILE: 1996-UO/TI-5 UNLOCATABLE COPYRIGHT OWNERS Amendment to the non-exclusive licence issued to Dr. Gerri Sinclair, Director, Exemplary Center for Interactive Technologies in Education (ExCITE), Faculty of Education, Simon Fraser University, Burnaby, B.C., authorizing the reproduction, on a CD-ROM, of eight published works REASONS FOR THE DECISION In 1996, ExCITE had filed a licence application with the Board under section 70.7 of the Copyright Act, to reproduce, on a CD-ROM entitled “The Prime Ministers of Canada on CD-ROM”, the following works: (i) A photograph of a helicopter and troops taken during the FLQ crisis in 1970 by George Bird, published in the Montreal Star; (ii) A photograph of Lester B. Pearson taken by Jack Olsen and published in the book entitled Maclean’s Canada - Portrait of a Country, McClelland and Stewart Limited, in 1960; (iii) A photograph of two hippies dancing (in the 1960s ?) ) photographer unknown ) published in the book entitled Design in Context by Penny Sparke, Quarto Publishing, London, England, 1987; (iv) A photograph of Pierre E. Trudeau and Lester B. Pearson at the 1968 federal-provincial conference, taken by Duncan Cameron and published in the book entitled The Illustrated History of Canada by Craig Brown in 1987; (v) A cartoon by Ed McNally showing John Diefenbaker holding the Quebec flag, published in the Montreal Star in 1965; Ottawa, le 12 janvier 1998 DOSSIER : 1996-UO/TI-5 TITULAIRES INTROUVABLES DE DROITS D’AUTEUR Modification à la licence non exclusive délivrée à madame Gerri Sinclair, directrice, Exemplary Center for Interactive Technologies in Education (ExCITE), Faculté de l’éducation, Université Simon Fraser, Burnaby, (C.-B.), autorisant la reproduction sur CD-ROM de huit œuvres publiées MOTIFS DE LA DÉCISION En 1996, ExCITE a déposé auprès de la Commission une demande de licence en vertu de l’article 70.7 de la Loi sur le droit d’auteur. Cette demande visait la reproduction, sur un CD-ROM intitulé The Prime Ministers of Canada on CD-ROM, des œuvres suivantes : (i) Une photographie d’un hélicoptère et troupes prise durant la crise du FLQ de 1970 par George Bird et publiée dans le Montreal Star; (ii) Une photographie de Lester B. - 2 -(vi) A photograph of the Parliament Hill buildings taken from the Quebec side ) photographer unknown ) published in the book entitled Ontario A Picture Book to Remember Her By, by Ted Smart, Crown Publishers, in 1979; (vii) A photograph of John Diefenbaker reading a piece of paper, taken by Duncan Cameron, published in the book entitled ... now show me your belly-button!, by Reuben Schafer and Ken Borden, in 1967; (viii) A photograph of a Peace March in New York ) photographer unknown ) published in the book entitled Peace, A Dream Unfolding, Kome & Crean, Editors (Sierra Club Books, 1986). Twenty thousand copies of the CD-ROM were to be made originally, distributed and sold to Canadian schools and eventually be available on the general interest market at a unit cost of $49.95. A new request was filed with the Board by ExCITE on November 27, 1997 to reproduce an additional 80,000 copies of the CD-ROM. On February 25, 1997, the Board granted a non-exclusive licence authorizing the applicant to reproduce the works described above. In its reasons for the decision, the Board was satisfied that the applicant had made all of the reasonable efforts, in the circumstances, to locate the copyright owners. The Board applies the same reasons in the case at hand since the copyright owners are the same for whom a licence was delivered earlier. Consequently, the Board grants a non-exclusive licence authorizing the applicant to reproduce the works described above. Pursuant to subsection 77(2) of the Copyright Act, the Board establishes the following terms and conditions: A) The expiry date of the licence The licence expires on December 31, 2001. The authorized reproduction must therefore be completed by that date. Vingt mille copies de ce CD-ROM devaient d’abord être reproduites, distribuées aux écoles du Canada et éventuellement mises à la disponibilité du public en général au coût de 49,95 $ l’unité. Une nouvelle demande a été déposée auprès de la Commission le 27 novembre 1997 pour reproduire 80 000 copies additionnelles du CD-ROM. La Commission a déjà émis le 25 février 1997 une licence non exclusive à la requérante autorisant la reproduction des œuvres décrites ci-dessus. Dans ses motifs de décision, la Commission a estimé que la requérante avait fait tout en son possible, dans les circonstances, pour retracer les titulaires de droits. La Commission applique les mêmes motifs à la présente requête étant donné que les titulaires de droits sont les mêmes que ceux pour lesquels une licence fut déjà délivrée. En conséquence, la Commission délivre une licence non exclusive à la requérante l’autorisant à reproduire les œuvres décrites ci-dessus. Conformément au paragraphe 77(2) de la Loi sur le droit d’auteur, voici les modalités établies par la Commission : A) La date d’expiration de la licence La licence expire le 31 décembre 2001. Toute reproduction autorisée devra être complétée d’ici cette date.
- 3 B) The type of use authorized The Board authorizes the applicant to reproduce no more than 80,000 additional copies of the works. C) The licence fee After consulting Vis*Art Copyright (for a total reproduction of 100,000 copies), the Board finds it appropriate that the licence fee be set at $403.35 per work for a total amount of $3,226.80. ExCITE has already paid an initial fee of $1,646.40 to Vis*Art for the reproduction of the first 20,000 copies; it therefore now owes a balance of $1,580.40 for the additional 80,000 copies. D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 77(2) of the Copyright Act to establish the “terms and conditions” of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, it may dispose of the amount of the royalties established in the licence as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before December 31, 2006, ownership of the copyright of any of the works covered by this licence. Thus, the Board orders that the sum provided for by the licence be paid to Vis*Art Copyright. C) Le coût de la licence Après consultation auprès de Vis*Art Droit d’auteur (pour un tirage total de 100 000 copies), la Commission estime approprié de fixer les droits de licence à payer à 403,35 $ l’œuvre, soit un total de 3 226,80 $. La requérante a déjà payé un coût initial de 1 646,40 $ à Vis*Art pour les 20 000 premières copies; elle doit donc maintenant un solde de 1 580,40 $ pour les 80 000 copies additionnelles. D) La détention des fonds et la disposition des fonds non réclamés La Commission est d’avis que le pouvoir dont elle dispose en vertu du paragraphe 77(2) de la Loi sur le droit d’auteur pour établir les «modalités» de la licence permet d’avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d’auteur introuvables sans imposer un fardeau démesuré au requérant. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d’auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d’auteur pourra ainsi s’adresser à la société de gestion plutôt que d’avoir à s’adresser aux tribunaux. Quant à la société de gestion, elle peut disposer du montant des droits fixés par la licence comme bon lui semble pour le bénéfice général de ses membres. Elle s’engage, toutefois, à rembourser toute personne qui établirait, avant le 31 décembre 2006, qu’elle détient le droit d’auteur sur toute œuvre faisant l’objet de la présente licence. À cet effet, la Commission ordonne que la somme prévue par la licence soit versée à Vis*Art Droit d’auteur.
