Copyright Board Commission du droit d’auteur Canada Canada Ottawa, June 11, 1997 FILE: 1997-UO/TI-1 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to the Lower Mainland WITT Association, authorizing the reproduction of a drawing REASONS FOR THE DECISION On November 25, 1996, Ms. Anabelle Paxton of the Lower Mainland WITT Association, filed a licence application with the Board under section 70.7 of the Copyright Act, to reproduce a drawing (artist unknown) of a woman working on a telephone pole on the first page of a phone-line manual. This manual will serve as a resource book for information of Women in Trades, Technologies and Blue-Collar Work in the Lower Mainland (Vancouver). The drawing will be shown only once in the book and the Lower Mainland WITT Association will print 40 copies in the first print-run as a field test version. In the application, Ms. Paxton described the efforts made to locate the copyright owner. She contacted the Nova Scotia WITT Association who had published the drawing in question in one of their leaflets three or four years ago. The Association could not remember where they had taken the drawing or who the artist was. It was difficult for Ms. Paxton to pursue her research as she did not have the name of the artist. The Board was satisfied that the applicant made the reasonable efforts, in the circumstances, to locate the copyright owner. Thus, the Board granted on January 22, 1997 a non-exclusive licence authorizing the applicant to reproduce the drawing described above. Cette demande visait la reproduction, sur la première page d’un bottin téléphonique, d’un dessin (dont l’artiste est inconnu) d’une femme travaillant sur un poteau de téléphone. Ce bottin servira comme manuel de renseignements sur les femmes œuvrant dans les secteurs des métiers, de la technologie et du travail manuel dans le Lower Mainland (Vancouver). Le dessin apparaîtra une seule fois dans le manuel et l’Association Lower Mainland WITT fera un premier tirage de 40 copies comme test exploratoire. Dans la demande, madame Paxton a décrit les efforts afin de retrouver le titulaire de droits. Elle a communiqué avec l’Association Nova Scotia WITT qui avait déjà publié le dessin en question dans une de leurs brochures il y a trois ou quatre ans. Cette Association ne pouvait se rappeler où elle avait pris le dessin et qui en était l’auteur. Il fut donc difficile pour madame Paxton de poursuivre ses recherches puisqu’elle ne connaissait pas le nom de l’artiste. La Commission a estimé que la requérante avait fait son possible, dans les circonstances, pour retracer le titulaire de droit. En conséquence, la Commission a émis le 22 janvier 1997 une licence non exclusive à la requérante l’autorisant à reproduire le dessin décrit ci-dessus.
- 2 Pursuant to subsection 70.7(2) of the Copyright Act, the Board established the following terms and conditions: A) The expiry date of the licence The licence expires on March 31, 1997. The authorized reproduction must therefore be completed by that date. B) The type of use authorized The Board authorizes the applicant to reproduce no more than 1,000 copies of the drawing described above. C) The licence fee After consulting Vis*Art Copyright Inc., the Board finds it appropriate that the licence fee be set at $35.65. D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 70.7(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, it may dispose of the amount of the royalties established in the licence as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before March 31, 2002, ownership of the copyright of the work covered by this licence. Conformément au paragraphe 70.7(2) de la Loi sur le droit d’auteur, voici les modalités établies par la Commission : A) La date d’expiration de la licence La licence expire le 31 mars 1997. On devra donc procéder à toute reproduction autorisée d’ici cette date. B) Le genre d’utilisation autorisée La Commission autorise la requérante à reproduire au plus 1 000 copies du dessin décrit ci-dessus. C) Le coût de la licence Après consultation auprès de Vis*Art Droit d’Auteur inc., la Commission estime approprié de fixer à 35,65 $ les droits de licence à payer. D) La détention des fonds et la disposition des fonds non réclamés La Commission est d’avis que le pouvoir dont elle dispose en vertu du paragraphe 70.7(2) de la Loi sur le droit d’auteur pour établir les «modalités» de la licence permet d’avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d’auteur introuvables sans imposer un fardeau démesuré au requérant. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d’auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d’auteur pourra ainsi s’adresser à la société de gestion plutôt que d’avoir à s’adresser aux tribunaux. Quant à la société de gestion, elle peut disposer du montant des droits fixés par la licence comme bon lui semble pour le bénéfice général de ses membres. Elle s’engage toutefois à rembourser toute personne qui établirait, avant le 31 mars 2002, qu’elle détient le droit d’auteur sur l’œuvre faisant l’objet de la présente licence.
