Copyright Board Canada Ottawa, March 16, 1998 FILE: 1998-UO/TI-9 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Fifth House Limited, Calgary, Alberta, authorizing the reprint of a book REASONS FOR THE DECISION On July 23, 1997, the Board granted a non-exclusive licence authorizing the applicant to reprint the book entitled Gully Farm written by Mary Hiemstra and originally published by McClelland and Stewart in 1955. This licence expired on December 31, 1997. In February 20, 1998, Fifth House Limited filed a second application to reprint up to 10,000 more copies of the same book, which will sell at the unit cost of $12.95. In its reasons for the decision for the first licence, the Board was satisfied that the applicant had made all of the reasonable efforts, in the circumstances, to locate the copyright owner. The circumstances have not changed since. Consequently, the Board grants a non-exclusive licence authorizing Fifth House Limited to reprint the work described above. Pursuant to subsection 77(2) of the Copyright Act, the Board establishes the following terms and conditions: Commission du droit d’auteur Canada Ottawa, le 16 mars 1998 DOSSIER : 1998-UO/TI-9 TITULAIRES DE DROITS D’AUTEUR INTROUVABLES Licence non exclusive délivrée à Fifth House Limited, Calgary (Alberta), autorisant la réimpression d’un livre MOTIFS DE LA DÉCISION La Commission a déjà délivré, le 23 juillet 1997, une licence non exclusive à la requérante l’autorisant à réimprimer le livre de Mary Hiemstra intitulé Gully Farm, originalement publié par McClelland and Stewart en 1955. Cette licence a expiré le 31 décembre 1997. Le 20 février 1998, Fifth House Limited a déposé une deuxième demande pour réimprimer au plus 10 000 copies additionnelles du livre qui se vendra 12,95 $ l’unité. Dans ses motifs de décision pour la première licence, la Commission a estimé que la requérante avait fait tout ce qui était possible, dans les circonstances, pour retracer la titulaire de droit. Les circonstances n’ont pas changé depuis. En conséquence, la Commission délivre une licence non exclusive autorisant Fifth House Limited à réimprimer l’œuvre décrite ci-dessus. Conformément au paragraphe 77(2) de la Loi sur le droit d’auteur, voici les modalités établies par la Commission :
- 2 A) The expiry date of the licence The licence expires on December 31, 2000. The authorized reprint must therefore be completed by that date. B) The type of use authorized The Board authorizes the applicant to reprint no more than 10,000 copies of the book described above. C) The licence fee After consulting the Canadian Copyright Licensing Agency (CANCOPY), the Board finds it appropriate that the licence fee be set at $500 plus a percentage (8%) of the retail price of $12.95 for each book sold. However, where a 50% discount has been extended to vendors purchasing stock on a non-returnable basis, Fifth House Limited will pay to CANCOPY a royalty rate of 8% of the net price of the book. The Board expects Fifth House Limited and CANCOPY to make suitable arrangements for the payments of the royalties related to book sales. D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 77(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. C) Le coût de la licence Après consultation auprès de la Canadian Copyright Licensing Agency (CANCOPY), la Commission estime approprié de fixer les droits de licence à payer à 500 $, plus un pourcentage (8 %) sur le prix de vente au détail de 12,95 $ pour chaque livre vendu. Cependant, lorsqu’un rabais de 50% sera accordé aux fournisseurs qui achètent un approvisionnement non consigné, Fifth House Limited paiera à CANCOPY un taux de 8% du prix net du livre ainsi vendu. La Commission s’attend à ce que Fifth House Limited et CANCOPY prennent les dispositions nécessaires pour le paiement des droits liés aux ventes du livre. D) La détention des fonds et la disposition des fonds non réclamés La Commission est d’avis que le pouvoir dont elle dispose en vertu du paragraphe 77(2) de la Loi sur le droit d’auteur pour établir les «modalités» de la licence permet d’avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d’auteur introuvables sans imposer un fardeau démesuré au requérant. - 3 approach the licensing body, rather than approaching the courts. As for the licensing body, it may dispose of the amounts of the royalties established in the licence as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before December 31, 2005, ownership of the copyright of the work covered by this licence. Thus, the Board orders that the amounts provided for by the licence be paid to CANCOPY. Quant à la société de gestion, elle peut disposer des montants des droits fixés par la licence comme bon lui semble, pour le bénéfice général de ses membres. Elle s’engage toutefois à rembourser toute personne qui établirait, avant le 31 décembre 2005, qu’elle détient le droit d’auteur sur l’œuvre faisant l’objet de la présente licence. À cet effet, la Commission ordonne que les montants prévus par la licence soient versés à CANCOPY.
