Copyright Board Commission du droit d’auteur Canada Canada Ottawa, January 12, 1998 FILE: 1997-UO/TI-21 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Éditions CEC, Anjou, Quebec, authorizing the reproduction of three excerpts of a text by Alain Serres and Yan Thomas REASONS FOR THE DECISION On November 25, 1997, Ms. Suzanne Berthiaume, on behalf of Éditions CEC, filed a licence application with the Board under subsection 77(1) of the Copyright Act, to reproduce, in a grammar teaching guide accompanying the textbook entitled “Mes ateliers de grammaire”, three excerpts of the text entitled Pourquoi un âne écrivit des livres pour les enfants? written by Alain Serres and Yan Thomas, published by Éditions Messidor/ La Farandole in 1992. The guide, to be used to teach French at the Secondary I school level, will have approximately 520 pages and 1,000 copies will be printed. It will sell at the unit cost of $99.95. The Board has already issued a first licence to Éditions CEC on July 2, 1996 and a second one on August 26, 1997, authorizing the reproduction of the same text in other textbooks. In its reasons for the decisions, the Board was satisfied that the applicant had made all of the reasonable efforts, in the circumstances, to locate the copyright owners. The circumstances have not changed since. Consequently, the Board grants a non-exclusive licence authorizing the applicant to reproduce the excerpts of the work described above. Pursuant to subsection 77(2) of the Copyright Act, the Board establishes the following terms and conditions: A) The expiry date of the licence The licence is for a period of five years and expires on December 31, 2002. Cette demande vise la reproduction, dans un guide d’enseignement grammatical accompagnant le manuel scolaire intitulé «Mes ateliers de grammaire», de trois extraits du texte intitulé « Pourquoi un âne écrivit des livres pour les enfants? » de Alain Serres et Yan Thomas, publié par les Éditions Messidor/La Farandole en 1992. Ce guide, destiné à l’enseignement du français au niveau du secondaire I, sera tiré à 1 000 exemplaires comportant environ 520 pages. Le prix de vente sera de 99,95 $ l’unité. La Commission a déjà délivré aux Éditions CEC une première licence le 2 juillet 1996 et une deuxième le 26 août 1997 autorisant la reproduction du texte en question dans d’autres ouvrages. Dans ses motifs de décisions, la Commission a estimé que la requérante avait fait tout ce qui était possible, dans les circonstances, pour retracer les titulaires de droits. Les circonstances n’ont pas changé depuis. En conséquence, la Commission délivre une licence non exclusive à la requérante l’autorisant à reproduire les extraits de l’œuvre décrite ci-dessus. Conformément au paragraphe 77(2) de la Loi sur le droit d’auteur , voici les modalités que fixe la Commission : A) La date d’expiration de la licence La licence est pour une période de cinq ans et expire le 31 décembre 2002.
- 2 B) The type of use authorized The Board authorizes the applicant to reproduce, in no more than 1,000 copies of the guide, the excerpts of the work described above. It also authorizes the photocopying of the excerpts for the use of the students. C) The licence fee After consulting l’Union des écrivaines et écrivains québécois (UNEQ), the Board finds it appropriate that the licence fee be set at $20. D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 77(2) of the Copyright Act to establish the “terms and conditions” of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, it may dispose of the amount of the royalties established in the licence as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before December 31, 2007, ownership of the copyright of the work covered by this licence. Thus, the Board orders that the sum provided for by the licence be paid to UNEQ. Elle autorise aussi la reprographie des extraits pour l’usage des étudiants. C) Le coût de la licence Après consultation auprès de l’Union des écrivaines et écrivains québécois (UNEQ), la Commission estime approprié de fixer à 20 $ les droits de licence à payer. D) La détention des fonds et la disposition des fonds non réclamés La Commission est d’avis que le pouvoir dont elle dispose en vertu du paragraphe 77(2) de la Loi sur le droit d’auteur pour fixer les «modalités» de la licence permet d’avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d’auteur introuvables sans imposer un fardeau démesuré au demandeur. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d’auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d’auteur pourra ainsi s’adresser à la société de gestion plutôt que d’avoir à s’adresser aux tribunaux. Quant à la société de gestion, elle peut disposer du montant des droits fixés par la licence comme bon lui semble pour le bénéfice général de ses membres. Elle s’engage toutefois à rembourser toute personne qui établirait, avant le 31 décembre 2007, qu’elle détient le droit d’auteur sur l’œuvre faisant l’objet de la présente licence. À cet effet, la Commission ordonne que la somme prévue par la licence soit versée à l’UNEQ.
