Copyright Board Canada Ottawa, March 26, 1998 FILE: 1998-UO/TI-1 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to The Friends of Algonquin Park, Whitney, Ontario, authorizing the reprint of a book REASONS FOR THE DECISION On January 5, 1998, Mr. Don Lloyd, on behalf of The Friends of Algonquin Park, filed a licence application with the Board under subsection 77(1) of the Copyright Act, to reprint the book entitled Incomplete Anglers written by John D. Robins and published by Wm. Collins & Sons (Canada) Limited in 1943. Two thousand copies will be printed and sold in Canada. In the application Mr. Lloyd described the efforts made to locate the copyright owner. The original publisher no longer exists. Mr. Lloyd therefore communicated with the Association of Canadian Publishers; they did not have any record of the book in question. He also contacted Harper-Collins, with the same negative result. As the author had once been a Professor of English at the Victoria College of the University of Toronto, the applicant made some research there. Don Lloyd, au nom de The Friends of Algonquin Park, déposait auprès de la Commission une demande de licence en vertu du paragraphe 77(1) de la Loi sur le droit d’auteur. Cette demande visait la réimpression du livre de John D. Robins intitulé Incomplete Anglers, publié par Wm. Collins & Sons (Canada) Limited en 1943. Deux mille copies seront tirées et vendues au Canada. Dans la demande, M. Lloyd a décrit les efforts faits afin de retrouver le titulaire de droit. La maison d’édition originale n’existe plus. M. Lloyd a donc communiqué avec l’Association des éditeurs canadiens; celle-ci ne détenait aucune information sur le livre en question. - 2 author. The applicant, however, found out from the Principal of Victoria College that John D. Robins had passed away in the 1950s. This was later confirmed by the Archivist of Victoria College; Mr. Robins had indeed passed away on December 18, 1952. No information could however be found on his succession. The Board was satisfied that the applicant made the reasonable efforts, in the circumstances, to locate the copyright owner. Thus, the Board granted on February 20, 1998, a non-exclusive licence authorizing the applicant to reprint the book described above. Pursuant to subsection 77(2) of the Copyright Act, the Board established the following terms and conditions: A) The expiry date of the licence The licence expires on December 31, 1998. The authorized reprint must therefore be completed by that date. B) The type of use authorized The Board authorizes the applicant to reprint no more than 2,000 copies of the book described above. C) The licence fee After consulting the Canadian Copyright Licensing Agency (CANCOPY), the Board finds it appropriate that the licence fee be set at $300 plus a percentage (8%) of the retail price for each book sold. The applicant will pay the initial amount of $300 to CANCOPY, however the Board expects that the applicant and CANCOPY will make suitable arrangements for the payments of the royalties related to book sales. détenait aucune information sur l’auteur. Cependant, le directeur du Collège Victoria a informé le requérant que John D. Robins était décédé dans les années 50. Ceci a été confirmé par la suite par l’archiviste du Collège Victoria; M. Robins est décédé le 18 décembre 1952. On ne détenait cependant aucune information sur sa succession. La Commission a estimé que le requérant avait fait son possible, dans les circonstances, pour retracer le titulaire de droit. En conséquence, la Commission a délivré le 20 février 1998 une licence non exclusive au requérant l’autorisant à réimprimer le livre décrit ci-dessus. Conformément au paragraphe 77(2) de la Loi sur le droit d’auteur, voici les modalités établies par la Commission : A) La date d’expiration de la licence La licence expire le 31 décembre 1998. On devra donc procéder à la réimpression autorisée d’ici cette date. B) Le genre d’utilisation autorisée La Commission autorise le requérant à réimprimer au plus 2 000 copies du livre décrit ci-dessus. C) Le coût de la licence Après consultation auprès de la Canadian Copyright Licensing Agency (CANCOPY), la Commission estime approprié de fixer les droits de licence à payer à 300 $, plus un pourcentage (8 %) sur le prix de vente au détail pour chaque livre vendu. Le requérant paiera le montant initial de 300 $ à CANCOPY, cependant la Commission s’attend à ce que le requérant et CANCOPY prennent les dispositions nécessaires pour le paiement des droits liés aux ventes du livre.
- 3 D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 77(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, it may dispose of the amounts of the royalties established in the licence as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before December 31, 2003, ownership of the copyright of the work covered by this licence. Thus, the Board orders that the amounts provided for by the licence be paid to CANCOPY. Le secrétaire de la Commission, Claude Majeau Secretary to the BoardD) La détention des fonds et la disposition des fonds non réclamés La Commission est d’avis que le pouvoir dont elle dispose en vertu du paragraphe 77(2) de la Loi sur le droit d’auteur pour établir les «modalités» de la licence permet d’avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d’auteur introuvables sans imposer un fardeau démesuré au requérant. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d’auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d’auteur pourra ainsi s’adresser à la société de gestion plutôt que d’avoir à s’adresser aux tribunaux. Quant à la société de gestion, elle peut disposer des montants des droits fixés par la licence comme bon lui semble, pour le bénéfice général de ses membres. Elle s’engage toutefois à rembourser toute personne qui établirait, avant le 31 décembre 2003, qu’elle détient le droit d’auteur sur l’œuvre faisant l’objet de la présente licence. À cet effet, la Commission ordonne que les montants prévus par la licence soient versés à CANCOPY.
