Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, October 22, 1999 FILE 1998-UO/TI-21 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to L’Information Essentielle inc., Lachine, Quebec, authorizing the reproduction and incorporation of two photographs, three film images, one song excerpt and one piece of film music in a documentary television series

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board issues a licence to L’Information Essentielle inc. as follows:

(1) The licence authorizes the reproduction and incorporation of the following works in the television documentary series Histoire d’un Canadien / The Maurice “Rocket” Richard Story:

a photograph of Maurice Richard behind the Iron Curtain, published in Parlons Sports, March 21, 1959;

a photograph of Maurice Richard winning the Hart Trophy, published in Nouvelles et Potins, January 25, 1958;

three film images in the documentary film Les Canadiens directed by Bob McKeown, 1985;

a 30-second excerpt of the song “Maurice Richard” by Yvon Dupuis and J. “Johnny” Laurendeau, performed by Jeanne D’Arc Charlebois and released on the Maple Leaf label in the 1950s; and

a 38-second piece of music performed by the GM Orchestra in the film The Battered Mug, directed by Jack Chisholm, 1936.

(2) The cinematographic image of each visual work above will appear for no more than 10 seconds in the four-hour documentary series.

(3) The licence also authorizes the public performance or communication to the public by telecommunication of the works so incorporated, as part of the exploitation of the documentary film.

(4) The licence is for five years and expires on October 22, 2004.

- 2 - (5) The licence is non-exclusive and valid only in Canada. (6) For the visual works (photographs and film images), L’Information Essentielle inc. will pay $345 for each photograph ($345 × 2 = $690) and $575 for each film image ($575 × 3 = $1725) for a total of $2415 to the Société de droits d’auteur en arts visuels (SODART), which may dispose of the royalties set by the licence as it sees fit, for the general benefit of its members. SODART undertakes, however, to reimburse any person who establishes, before October 22, 2009, ownership of the copyright in one or more of the works covered by this licence.

(7) For the musical arrangements of the excerpt of the song “Maurice Richard” by J. “Johnny” Laurendeau, L’Information Essentielle inc. will pay $93.75 to the Society for Reproduction Rights of Authors, Composers and Publishers in Canada (SODRAC), which may dispose of the royalties set by the licence as it sees fit, for the general benefit of its members. SODRAC undertakes, however, to reimburse any person who establishes, before October 22, 2009, ownership of the copyright in the musical arrangements of the work covered by this licence.

(8) For the piece of music from the film The Battered Mug, L’Information Essentielle inc. will pay $250 to the Canadian Musical Reproduction Rights Agency (CMRRA), which may dispose of the royalties set by the licence as it sees fit, for the general benefit of its members. CMRRA undertakes, however, to reimburse any person who establishes, before October 22, 2009, ownership of the copyright in the work covered by this licence.

(9) The coming into force of this licence is conditional on the filing with the Board of receipts from SODART, SODRAC and the CMRRA respectively for the amount of the licence, accompanied by undertakings by each of them to comply with the conditions set out in paragraph (4) above.
