Copyright Board Canada Ottawa, March 16, 1992 FILE 1992-UO/TI-2 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive interim licence issued to Goose Lane Editions, Fredericton, New Brunswick, authorizing the reprinting of a photograph from a book. Pursuant to the provisions of sections 66.51 and 70.7 of the Copyright Act, the Copyright Board grants an interim licence to Goose Lane Editions (hereinafter, "the applicant"), as follows: 1) The licence authorizes the reprinting of a colour photograph of an ornamental mask by W. and B. Forman appearing at page 55 of a book entitled Benin Art by Paul Hamlyn, published by Batchworth Press Limited in 1960. The photograph will be reprinted on the cover of a novel entitled Fadimatu with a press run of no more than 4,000. The licence also authorizes Goose Lane Editions to reproduce the photograph for the purpose of advertising the novel. 2) The licence expires on July 1, 1992. 3) The licence is non-exclusive and valid only in Canada. 4) The Board shall set the licence fee after it has received from the applicant, on a confidential basis, examples of licence agreements it has entered into since 1990 for the reproduction of photographs or other works of art on the cover of books. The applicant shall pay that amount to VIS*ART which shall hold the funds in trust, for the benefit of the copyright owner for this work, until June 30, 1997. La licence autorise également Goose Lane Editions à reproduire la photographie dans sa campagne publicitaire pour le roman. 2) La licence expire le 1 er juillet 1992. 3) La licence est non exclusive et valide seulement au Canada. 4) La Commission fixera le montant de la licence une fois que la demanderesse lui aura fourni, sur une base confidentielle, des exemples d'ententes qu'elle a conclues depuis 1990 pour obtenir une licence l'autorisant à reproduire des photographies ou autres oeuvres d'art sur la couverture de livres. La demanderesse versera le montant de la licence à VIS*ART qui le détiendra en fiducie pour le compte du titulaire du droit d'auteur sur l'oeuvre jusqu'au 30 juin
- 2 this amount and accumulated interest as it sees fit for the general benefit of its members. 5) The applicant shall provide to the Board an affidavit from its representative attesting to the efforts undertaken to locate the copyright owners and to their lack of success. 6) This licence is conditional upon the applicant providing to the Board the material described in paragraphs 4) and 5), no later than March 31, 1992. 7) Reasons for the order will be issued at the time of the Board's final decision.
