Copyright Board Commission du droit d’auteur Canada Canada Ottawa, July 6, 2000 FILE: 1999-UO/TI-18 UNLOCATABLE COPYRIGHT OWNER Non-exclusive licence issued to the Supreme Court of Canada for the use and reproduction of a photograph

Pursuant to the provisions of section 77(1) of the Copyright Act, the Copyright Board grants a licence to the Supreme Court of Canada as follows:

(1) The licence authorizes the use and reproduction of a photograph of Justice J.W. Estey, published in the Ottawa Citizen on January 23, 1956, in a commemorative book marking the 125th anniversary of the creation of the Supreme Court of Canada.

No more than 4,000 copies of the work shall be reproduced. Issuance of this licence does not release the applicant from the obligation to obtain permission for any other use not covered by this licence.

(2) The licence expires on December 31, 2000. The authorized use and reproduction must therefore be completed by that date.

(3) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(4) The Supreme Court of Canada will pay the sum of $452 to the Société de droits d'auteur en arts visuels (SODART). SODART may dispose of the amount as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before December 31, 2005, ownership of the copyright of the work covered by this licence.

(5) The coming into force of this licence is conditional on the applicant's filing with the Board a receipt from SODART for the amount of the royalty specified in the licence, accompanied by SODART's undertaking to comply with the conditions set out in paragraph (4) above.
