Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, September 13, 2000 FILE 2000-UO/TI-22 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Guérin Éditeur Ltée, Montréal, Quebec, authorizing the reproduction of an excerpt of a poem by Louise Dulude-Bennett

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board issues a licence to Guérin Éditeur Ltée, as follows:

(1) The licence authorizes the reproduction of an excerpt of an untitled poem by Louise Dulude-Bennett published in Poésie 1 by Ferron Éditeur Inc. in 1972, in the literacy workbook Le Quotidien published by Guérin-Éditeur Ltée.

No more than 3000 copies shall be reproduced. (2) The licence expires on December 31, 2000. Any authorized reproduction must be completed by this date.

(3) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(4) Guérin Éditeur Ltée will pay the sum of $18 to the Société de gestion collective des droits de reproduction (COPIBEC), which may dispose of the amount of the royalties set by the licence as it sees fit for the general benefit of its members. COPIBEC undertakes, however, to reimburse any person who establishes, before December 31, 2005, ownership of the copyright in the work covered by this licence.

(5) The coming into force of this licence is conditional on COPIBEC filing with the Board the receipt for the amount of royalties set in the licence, accompanied by an undertaking by COPIBEC to comply with the conditions set out in paragraph (4) above.
