Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board of Canada grants a licence to 9224-0241 Québec Inc., as follows:
(1) The licence authorizes the synchronization of a 1 minute 40 second excerpt from the musical work We’ll Have a Ball in Montreal by Pierre Lalonde, Pierre Nolès and F. Powell, published by Éditions Beau Rivage, the reproduction and communication to the public by telecommunication of the excerpt in a film entitled La couleur de tes lèvres (Le Souffle), and the transfer of ownership of this excerpt incorporated in the film that is in the form of a tangible object.
(2) The licence is valid retroactively from the date of the first reproduction, that is, October 18, 2017. The licence shall expire when the work enters the public domain.
(3) The licence is non-exclusive and valid only in Canada. For any other country, it is the law of that country that applies.
(4) The licensee shall pay the sum of $400 to the Society for reproduction rights of authors, composers and publishers in Canada (SODRAC), which may dispose of the amount as it sees fit for the general benefit of its members. SODRAC undertakes, however, to reimburse any person who, within 5 years upon expiry of this licence, establishes ownership of the copyright in the work covered by this licence.
(5) The coming into force of this licence is conditional on SODRAC filing with the Board a Notice of Receipt of Payment and Undertaking in which it undertakes to comply with the conditions set out in paragraph (4), above.
