Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, October 10, 2019 FILE 2019-UO/TI-03 UNLOCATABLE COPYRIGHT OWNER Non-exclusive licence issued to Cossette Communication Inc., Montréal, Quebec, authorizing the reproduction, synchronization and communication to the public by telecommunication of a photograph in an advertisement

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board of Canada grants a licence to Cossette Communication Inc., as follows:

(1) The licence authorizes the reproduction, synchronization and communication to the public by telecommunication on the Internet and on television of the image of Marie Carmen’s Miel et Venin album (1992) taken by Daniel Poulin and the incorporation of this image in an advertisement.

The film image of the photograph lasts 2 seconds at most in the 30-second advertisement. The issuance of the licence does not release the licensee from the obligation to obtain permission for any other uses not covered by this licence.

(2) The licence is valid from the date of the reproduction, that is, January 30, 2019, and expires on January 30, 2024.

(3) The licence is non-exclusive and valid only in Canada. For any other country, it is the law of that country that applies.

(4) The licensee shall pay the sum of $445.15 to the Society of Composers, Authors and Music Publishers of Canada (SOCAN), which may dispose of the amount as it sees fit for the general benefit of its members. SOCAN undertakes, however, to reimburse any person who, within 5 years upon expiry of this licence, establishes ownership of the copyright in the work covered by this licence.

(5) The coming into force of this licence is conditional on SOCAN filing with the Board a Notice of Receipt of Payment and Undertaking of the royalties fixed in the licence, accompanied by its undertaking to comply with the conditions set out in paragraph (4), above.
