FILE 2020-UO/TI-02 UNLOCATABLE COPYRIGHT OWNER Non-exclusive licence issued to Eric Hebert, Ottawa, Ontario, authorizing the reproduction of postcards and the selling or other transfer of ownership of the reproductions

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board grants a licence to Eric Hebert as follows:

(1) The licence authorizes the reproduction of 60 postcards reproduced in the self-published book Killarney A Post Card History.

(2) The licence authorizes the selling or other transfer of ownership of no more than 5,000 reproductions of each postcards.

(3) The licence applies only to postcards for which copyright has not expired when this licence is issued.

(4) The issuance of the licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.

(5) The licence expires in respect of each work at the time the work enters the public domain.

(6) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(7) Upon request by each person who establishes that they are the owner of copyright in a work no later than five years after the expiry of copyright in that work, the licensee will pay that person the sum of eight dollars and seventy-two cents ($8.72) for each work for which they have established ownership.

(8) The owner of copyright in a work is entitled to end the licence with respect to future uses of that work. A copyright owner who terminates the licence is still entitled to the royalties described in section (7).

2 (9) The coming into force of this licence is conditional on the licensee filing with the Board a Notice of Undertaking to comply with the conditions set out in section (7) above.
