UNLOCATABLE COPYRIGHT OWNER FILE 2023-UO/TI-04 Ottawa, July 11, 2023 Non-exclusive licence issued to Balado Boréal, Chicoutimi, Quebec, authorizing the reproduction of a fixation of a communication signal

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board grants a licence to Balado Boréal as follows:

The licence authorizes the reproduction of the fixation of an extract of a communication signal broadcast by Radio CJMT 1240 AM on May 4, 1981 that was made without the authorization of the broadcaster.

The licence authorizes the reproduction in a podcast. The issuance of the licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.

The licence is valid from April 1, 2023 to March 31, 2033. The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

The licensee will pay the sum of twenty-five dollars ($25) to anybody who establishes, before March 31, 2038, ownership of the copyright in the work covered in this licence.

The copyright owner can terminate the licence by presenting a written notice to this effect to the licensee. The licensee will cease using the work for the uses granted in this licence, no later than 30 days after the receipt of the notice. The copyright owner who terminates the licence is still entitled to the royalties described in paragraph (7).

The coming into force of this licence is conditional on the licensee filing with the Board a Notice of Undertaking to comply with the conditions set out in paragraph (7) above.
