- 1 -Ottawa, April 23, 2010 File: 2009-UO/TI-25 Reasons for the Decision [1] On October 15, 2009, the Ministère de l’Éducation, du Loisir et du Sport Québec (MELS) applied to the Board for a licence for the use of an unlocatable owner’s work pursuant to subsection 77(1) of the Copyright Act (the “Act”) 1 in order to use the soundtrack of the video recording of a speech delivered by Severn Cullis-Suzuki at the Earth Summit held in Rio de Janeiro in 1992. The MELS intends to make the soundtrack available on a secure site, access to which is restricted to evaluation specialists from school boards and private educational institutions. Once downloaded by one of the individuals in question, the soundtrack would be burned onto a CD or DVD and performed in public in the course of a test. [2] The MELS has obtained Ms. Cullis-Suzuki’s consent to use the transcript of her speech. However, she has specified that she does not own the rights to the video recording. [3] There is no need to issue a licence in the circumstances because the MELS falls under the exception set out in subsection 29.4(2) of the Act. [4] The relevant provisions of the Act read as follows: 2. In this Act, [...] “commercially available” means, in relation to a work or other subject-matter, Ottawa, le 23 avril 2010 Dossier : 2009-UO/TI-25 Motifs de la décision [1] Le 15 octobre 2009, le Ministère de l’Éducation, du Loisir et du Sport Québec (MELS) a déposé une demande auprès de la Commission pour une licence d’utilisation d’une œuvre dont le titulaire de droit est introuvable en vertu du paragraphe 77(1) de la Loi sur le droit d’auteur (la « Loi ») 1 afin d’utiliser la trame sonore de l’enregistrement vidéo d’un discours prononcé par Severn Cullis-Suzuki dans le cadre du Sommet sur la Terre qui s’est tenu à Rio de Janeiro en 1992. Le MELS entend afficher la trame sonore sur un site sécurisé dont l’accès est autorisé exclusivement aux responsables de l’évaluation dans les commissions scolaires et établissements d’enseignement privé. Une fois téléchargée par une telle personne, la trame serait gravée sur un CD ou DVD pour être ensuite exécutée en public lors de l’administration de l’examen. [2] Le MELS a obtenu le consentement de M me Cullis-Suzuki pour utiliser la transcription de son discours. Elle affirme toutefois ne pas être titulaire des droits sur l’enregistrement vidéo. [3] Il n’y a pas lieu de délivrer une licence en l’espèce puisque le MELS est en mesure de se prévaloir de l’exception prévue au paragraphe 29.4(2) de la Loi. [4] Les dispositions pertinentes de la Loi se lisent comme suit : 2. Les définitions qui suivent s’appliquent à la présente loi, [...] « accessible sur le marché » S’entend, en
- 2 -(a) available on the Canadian market within a reasonable time and for a reasonable price and may be located with reasonable effort, or (b) for which a licence to reproduce, perform in public or communicate to the public by telecommunication is available from a collective society within a reasonable time and for a reasonable price and may be located with reasonable effort; [...] “educational institution” means (a) a non-profit institution licensed or recognized by or under an Act of Parliament or the legislature of a province to provide pre-school, elementary, secondary or post-secondary education, (b) a non-profit institution that is directed or controlled by a board of education regulated by or under an Act of the legislature of a province and that provides continuing, professional or vocational education or training, (c) a department or agency of any order of government, or any non-profit body, that controls or supervises education or training referred to in paragraph (a) or (b), [...] 29.4(2) It is not an infringement of copyright for an educational institution or a person acting under its authority to (a) reproduce, translate or perform in public on the premises of the educational institution, [...] ce qui concerne une œuvre ou de tout autre objet du droit d’auteur a) qu’il est possible de se procurer, au Canada, à un prix et dans un délai raisonnables, et de trouver moyennant des efforts raisonnables; b) pour lequel il est possible d’obtenir, à un prix et dans un délai raisonnables et moyennant des efforts raisonnables, une licence octroyée par une société de gestion pour la reproduction, l’exécution en public ou la communication au public par télécommunication, selon le cas. [...] « établissement d’enseignement » : a) Établissement sans but lucratif agréé aux termes des lois fédérales ou provinciales pour dispenser de l’enseignement aux niveaux préscolaire, élémentaire, secondaire ou postsecondaire, ou reconnu comme tel; b) établissement sans but lucratif placé sous l’autorité d’un conseil scolaire régi par une loi provinciale et qui dispense des cours d’éducation ou de formation permanente, technique ou professionnelle; c) ministère ou organisme, quel que soit l’ordre de gouvernement, ou entité sans but lucratif qui exerce une autorité sur l’enseignement et la formation visés aux alinéas a) et b); [...] 29.4(2) Ne constituent pas des violations du droit d’auteur, si elles sont faites par un établissement d’enseignement ou une personne agissant sous l’autorité de celui-ci dans le cadre d’un examen ou d’un
- 3 a work or other subject-matter as required for a test or examination. (3) Except in the case of manual reproduction, the exemption from copyright infringement provided by paragraph (1)(b) and subsection (2) does not apply if the work or other subject-matter is commercially available in a medium that is appropriate for the purpose referred to in that paragraph or subsection, as the case may be. [5] The MELS is an educational institution within the meaning of paragraph (c) of the definition. The MELS therefore benefits from the exception set out in subsection 29.4(2). [6] The intended uses also meet the requirements of the exception. The reproduction or public performance of a work or other subject-matter must be “required for a test or examination”. That is certainly the case here. The exceptions are users’ rights that must not be interpreted restrictively. 2 The reproductions made in the preparatory stages of the test are “required for a test” to the same extent as the performance during the administration of the test. [7] Moreover, the limitations to the exception set out in subsection 29.4(3) do not apply because the video recording is not “commercially available”. Although it is possible to obtain a copy of the video on YouTube for a reasonable price (free), it is not known whether the rights have been cleared for these copies, or whether making a copy of those copies is authorized. The ability to obtain or make an infringing copy for a reasonable price cannot be what is meant by “commercially available” in paragraph (a) of the definition. Nor is it possible to obtain a licence contrôle : a) la reproduction, la traduction ou l’exécution en public d’une œuvre ou de tout autre objet du droit d’auteur dans les locaux de l’établissement; [...] (3) Sauf cas de reproduction manuscrite, les exceptions prévues à l’alinéa (1)b) et au paragraphe (2) ne s’appliquent pas si l’œuvre ou l’autre objet du droit d’auteur sont accessibles sur le marché et sont sur un support approprié, aux fins visées par ces dispositions. [5] Le MELS constitue un établissement d’enseignement en vertu de l’alinéa c) de la définition. Le MELS est donc visé par l’exception prévue au paragraphe 29.4(2). [6] Il en est de même pour les utilisations envisagées. La reproduction et l’exécution en public d’une œuvre ou autre objet de droit d’auteur doit se faire « dans le cadre d’un examen ou d’un contrôle ». Tel est forcément le cas en l’espèce. Les exceptions sont des droits des utilisateurs qui ne doivent pas être interprétés restrictivement. 2 Les reproductions faites pendant les étapes préparatoires à la tenue de l’examen se font tout autant « dans le cadre de l’examen » que la diffusion effectuée au moment de l’examen. [7] Par ailleurs, les limites à l’exception que prévoit le paragraphe 29.4(3) ne jouent pas car l’enregistrement vidéo n’est pas « accessible sur le marché ». Même si on peut se procurer le vidéo à un prix raisonnable sur YouTube (gratis), on ne sait pas si les droits ont été libérés sur ces copies, encore moins s’il est autorisé de copier la copie. Le fait de pouvoir se procurer ou faire une copie pirate à bon prix ne peut correspondre aux circonstances visées par l’alinéa a) de la définition de « accessible sur le marché ». On ne peut pas non plus se procurer de
- 4 from a collective society. To the best of our knowledge, there is no collective society active in this market, nor is there any way of knowing whether the work is part of a repertoire. [8] Conséquemment, la Commission est d’avis qu’une licence n’est pas nécessaire en l’espèce.
