Crawford authorizing the reproduction of all or major portions of seven published articles in an anthology on Canadian garden writing REASONS FOR THE DECISION On September 18, 1995, Ms. Edwinna von Baeyer and Ms. Pleasance K. Crawford, co-editors, filed a licence application with the Board under section 70.7 of the Copyright Act, to reproduce, in a textbook entitled "Garden Voices: Two centuries of Canadian Garden Writing", all or major portions of the seven published articles described below: (i) “The Kitchen Garden and Production”, by Dorothy Perkins (pen name of Adele H. Crawford, co-éditrices, déposaient auprès de la Commission une demande de licence en vertu de l'article 70.7 de la Loi sur le droit d'auteur. Todd, published in Canadian Homes and Gardens, Maclean Hunter Publisher, 1929 Length of quotation: 704 words This anthology of more than 300 pages will be published by Random House of Canada and 4,000 copies will be printed. It will sell at the unit cost of approximately $28.95 and will be comprised of more than 89 selected texts of Canadian authors. In the application and in sworn statements dated November 8 and 11, 1995, Ms. von Baeyer and Ms. Crawford described the efforts made to locate the copyright owners. They contacted, amongst other bodies, the Canadian Authors Association, the Writers Association of Canada, the Writers Union of Canada, the Federation of British Columbia Writers, the Periodical Writers Association of Canada, the Editor’s Association of Canada, the Canadian Society of Landscape Architects as well as the Canadian Copyright Licensing Agency (CANCOPY). The applicants have also communicated with each of the editors who published the works in question, have consulted various reference manuals on Canadian authors who wrote on Canadian gardening and communicated with them as well as with garden clubs and prominent landscape architects. In addition, where possible, they contacted alumnae records of universities and colleges attended by some of the authors. In one particular case, they contacted the Curator of Archival Collections of the Montreal McCord Museum where the works of one of the authors concerned had been exhibited. Many people having the same family name were also contacted by means of research through regular telephone directories or CD-ROM phone books. The Board was satisfied that the applicants made the reasonable efforts in the circumstances to locate the copyright owners. Thus, the Board granted on November 16, 1995, a non-exclusive licence authorizing the applicants to reproduce the articles described above. vi) «Uptown Radichetta» par Carol Stairs, publié dans Harrowsmith en 1979 Longueur de l'extrait : 1 342 mots vii) «Where Nature Is Abetted» par Frederick G. Les requérantes ont également communiqué avec chacun des éditeurs qui ont publié les titres en question, consulté divers ouvrages de référence sur les auteurs canadiens qui ont écrit sur le jardinage et communiqué avec ces différents auteurs ainsi qu'avec différents clubs de jardinage et paysagistes de renom. Elles ont de plus fait des démarches, lorsque c'était possible, auprès des associations des anciens des collèges et universités fréquentés par ces auteurs. Dans un autre cas, elles ont contacté le conservateur de la collection des archives du musée McCord à Montréal où on a déjà exposé le fruit du travail d'un des auteurs concernés. Plusieurs personnes portant le même nom ont également été appelées suite à des recherches faites à partir des bottins téléphoniques (conventionnels et CD-ROM). La Commission a estimé que les requérantes ont fait leur possible, dans les circonstances, pour retracer les titulaires de droits. En conséquence, la Commission a émis le 16 novembre 1995, une licence non exclusive aux requérantes les autorisant à reproduire les articles décrits ci-haut.
- 3 Pursuant to subsection 70.7(2) of the Copyright Act, the Board establishes the following terms and conditions: A) The expiry date of the licence The licence expires on December 31, 1995. The authorized reproduction must therefore be completed by that date. B) The type of use authorized The Board authorizes the applicants to reproduce, in no more than 4,000 copies, the articles described above. C) The licence fee After consulting the Canadian Copyright Licensing Agency (CANCOPY), the Board finds it appropriate that the licence fee be set at $300, as follows: ! Dorothy Perkins: nil * ! Claudette Burton: $100 ! Holland Cox: nil * ! Jean McKinley: $75 ! Frances Steinhoff Sanders: $25 ! Carol Stairs: $100 ! Frederick G. Todd: nil * (* CANCOPY did not allocate a value in this instance) D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 70.7(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. Dorothy Perkins : nil * ! Claudette Burton : 100 $ ! Holland Cox : nil * ! Jean McKinley : 75 $ ! Frances Steinhoff Sanders : 25 $ ! Carol Stairs : 100 $ ! Frederick G. Todd : nil * (* CANCOPY n’a pas attribué de valeur dans ce cas-ci) D) La détention des fonds et la disposition des fonds non réclamés La Commission est d'avis que le pouvoir dont elle dispose en vertu du paragraphe 70.7(2) de la Loi sur le droit d'auteur pour établir les «modalités» de la licence permet d'avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d'auteur introuvables sans imposer un fardeau démesuré au requérant.
- 4 By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, if the owner does not appear within five years of the expiry of the licence, it may retain the amount of the royalties established in the licence with accumulated interest, in the general interest of its members. Thus, the Board ordered that the sum provided for by the licence be paid into a trust fund held by the Canadian Copyright Licensing Agency (CANCOPY) who has informed the Board that it is ready and able to administer these funds. Le secrétaire de la Commission, Claude Majeau Secretary to the BoardLa Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d'auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d'auteur pourra ainsi s'adresser à la société de gestion plutôt que d'avoir à s'adresser aux tribunaux. Quant à la société de gestion, elle pourra, dans l'intérêt général de ses membres, conserver le montant des droits fixés par la licence et les intérêts accumulés si le titulaire ne se manifeste pas dans les cinq ans suivant l'expiration de la licence. À cet effet, la Commission a ordonné que la somme prévue par la licence soit versée dans un fonds en fiducie, détenu par la Canadian Copyright Licensing Agency (CANCOPY), qui a indiqué à la Commission qu'elle est à la fois disposée et en mesure d'administrer ce fonds.
