Copyright Board Commission du droit d’auteur Canada Canada Ottawa, August 30, 1996 FILE: 1996-UO/TI-3 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Éditions CEC authorizing the reproduction of a text by Alain Serres and Yan Thomas, one photograph by Jordi Serra-Cobo and one photograph by Yann Jondeau REASONS FOR THE DECISION On March 8, 1996, Ms. Anne Melançon, on behalf of Éditions CEC, filed a licence application with the Board under section 70.7 of the Copyright Act, to reproduce, in a textbook entitled " Mon encyclopédie ", the following works: ! a text entitled "Pourquoi un âne écrivit des livres pour les enfants? " written by Alain Serres and Yan Thomas, published by Éditions Messidor/La Farandole in 1992; ! a photograph by Jordi Serra-Cobo published in the magazine Sciences et Vie Junior, No. 55, January 1994; ! a photograph by Yann Jondeau published in Je bouquine, No. 125, Bayard Presse, July 1994. The textbook, to be used to teach French at the Grade 1 elementary school level, will have 204 pages and 12,000 copies will be printed. It will sell at the unit cost of $23.95. In the application and in a sworn statement dated July 22, 1996, Ms. Melançon described the efforts made to locate the copyright owners. Cette demande visait la reproduction, dans un manuel scolaire intitulé «Mon encyclopédie», des œuvres suivantes : ! un texte intitulé «Pourquoi un âne écrivit des livres pour les enfants? » de Alain Serres et Yan Thomas, publié par les Éditions Messidor/La Farandole en 1992; ! une photographie par Jordi Serra-Cobo parue dans le magazine Sciences et Vie Junior, n o 55, janvier 1994; ! une photographie par Yann Jondeau parue dans «Je bouquine», n o 125, Bayard Presse, juillet 1994. Cet ouvrage, destiné à l’enseignement du français au niveau de 1 ère année primaire, sera tiré à 12 000 exemplaires comportant 204 pages. Le prix de vente sera de 23,95 $. Dans la demande, ainsi que dans une déclaration assermentée en date du 22 juillet 1996, madame Melançon a décrit les efforts faits afin de retrouver les titulaires de droits.
- 2 Ms. Melançon has written to the copyright owners and contacted, amongst other bodies, the editor of the magazine Sciences et Vie Junior as well as SPADEM ( Société des auteurs des arts visuels), ADAGP ( Société dans les arts graphiques et plastiques ) and Société de l’image, in Paris, France. She also communicated with the firm Permission inc. in Montreal, which specializes in copyright discharge. These inquiries were of no avail. The Board was satisfied that the applicant made reasonable efforts to locate the copyright owners. Thus, the Board granted on July 2, 1996 a non-exclusive licence authorizing the applicant to reproduce the works described above. Pursuant to subsection 70.7(2) of the Copyright Act, the Board establishes the following terms and conditions: A) The expiry date of the licence The licence will expire on September 30, 1996. The authorized reproduction must therefore be completed by that date. B) The type of use authorized The Board authorizes the applicant to reproduce, in no more than 12,000 copies of the textbook, the following works: ! a text entitled "Pourquoi un âne écrivit des livres pour les enfants? " written by Alain Serres and Yan Thomas, published by Éditions Messidor/La Farandole in 1992; ! a photograph by Jordi Serra-Cobo published in the magazine Sciences et Vie Junior, No. 55, January 1994; ! a photograph by Yann Jondeau published in Je bouquine, No. 125, Bayard Presse, July 1994. Madame Melançon a écrit aux titulaires de droits d’auteur et communiqué, entre autres, avec l’éditeur de la revue Sciences et Vie Junior ainsi que la SPADEM (Société des auteurs des arts visuels), l’ADAGP (Société dans les arts graphiques et plastiques) et la Société de l’image, Paris, France. Elle a également communiqué avec l’entreprise Permission inc. à Montréal, qui se spécialise dans la libération de droits d’auteur. Ces démarches n’ont donné aucun résultat. La Commission a estimé que la demanderesse a fait tout ce qui était possible, dans les circonstances, pour retracer les titulaires de droits. En conséquence, la Commission a émis le 2 juillet 1996 une licence non exclusive à la demanderesse l’autorisant à reproduire les œuvres décrites ci-dessus. Conformément au paragraphe 70.7(2) de la Loi sur le droit d’auteur , voici les modalités que fixe la Commission : A) La date d’expiration de la licence La licence expire le 30 septembre 1996. On devra donc procéder à la reproduction autorisée d’ici cette date. B) Le genre d’utilisation autorisée La Commission autorise la demanderesse à reproduire dans au plus 12 000 exemplaires du manuel scolaire, les œuvres suivantes : ! un texte intitulé «Pourquoi un âne écrivit des livres pour les enfants? » de Alain Serres et Yan Thomas, publié par les Éditions Messidor/La Farandole en 1992; ! une photographie par Jordi Serra-Cobo parue dans le magazine Sciences et Vie Junior, n o 55, janvier 1994; ! une photographie par Yann Jondeau parue dans «Je bouquine», n o 125, Bayard Presse, juillet 1994.
- 3 C) The licence fee After consulting l’Union des écrivaines et écrivains québécois (UNEQ) and Vis*Art Copyright, the Board finds it appropriate that the licence fee be set as follows: $100 for the text and $130 for each of the photographs, totalling $360. D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 70.7(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, if the owner does not appear within five years of the expiry of the licence, it may retain the amount of the royalties established in the licence with accumulated interest, in the general interest of its members. Thus, the Board orders that the sum provided for by the licence be paid into a trust fund held by UNEQ, who has informed the Board that it is ready and able to administer these funds. Le secrétaire de la Commission, Claude Majeau Secretary to the BoardC) Le coût de la licence Après consultation auprès de l’Union des écrivaines et écrivains québécois (UNEQ) et Vis*Art, la Commission estime approprié de fixer les droits de licence à payer comme suit : 100 $ pour le texte et 130 $ pour chacune des photos, soit un total de 360 $. D) La détention des fonds et la disposition des fonds non réclamés La Commission est d’avis que le pouvoir dont elle dispose en vertu du paragraphe 70.7(2) de la Loi sur le droit d’auteur pour fixer les «modalités» de la licence permet d’avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d’auteur introuvables sans imposer un fardeau démesuré au demandeur. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d’auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d’auteur pourra ainsi s’adresser à la société de gestion plutôt que d’avoir à s’adresser aux tribunaux. Quant à la société de gestion, elle pourra, dans l’intérêt général de ses membres, conserver le montant des droits fixés par la licence et les intérêts accumulés si le titulaire ne se manifeste pas dans les cinq ans suivant l’expiration de la licence. À cet effet, la Commission ordonne que la somme prévue par la licence soit versée dans un fonds en fiducie, détenu par l’UNEQ, qui a indiqué à la Commission qu’elle est à la fois disposée et en mesure d’administrer ce fonds.
