Crawford authorizing the reproduction of all or major portions of seven published articles in an anthology on Canadian garden writing (paperback version) REASONS FOR THE DECISION On September 18, 1995, Ms. Edwinna von Baeyer and Ms. Pleasance K. Crawford, co-editors, had filed a licence application with the Board under section 70.7 of the Copyright Act, to reproduce, in the hardback version of a textbook entitled "Garden Voices: Two centuries of Canadian Garden Writing", all or major portions of the seven published articles described below. On October 28, 1996, they filed a second application for the paperback version of the textbook, to reproduce the same articles, i.e.: (i) “The Kitchen Garden and Production”, by Dorothy Perkins (pen name of Adele H. Crawford autorisant la reproduction, en tout ou en partie, de sept articles publiés, dans une anthologie portant sur le jardinage au Canada (version livre de poche) MOTIFS DE LA DÉCISION Le 18 septembre 1995, mesdames Edwinna von Baeyer et Pleasance K. Crawford, co-éditrices, déposaient auprès de la Commission une demande de licence en vertu de l'article 70.7 de la Loi sur le droit d'auteur. Cette demande visait la reproduction, en tout ou en partie, dans la version cartonnée d’un livre intitulé «Garden Voices: Two centuries of Canadian Garden Writing», des sept articles publiés ci-dessous. Le 28 octobre 1996, elles déposaient une seconde demande pour la version livre de poche du volume, pour la reproduction des mêmes articles, soit : i) «The Kitchen Garden and Production», par Dorothy Perkins (nom de plume de Adele H. Todd, published in Canadian Homes and Gardens, Maclean Hunter Publisher, 1929 Length of quotation: 704 words This anthology of more than 300 pages was published, in a harback version, by Random House of Canada in 1995. Random House now wishes to publish the book in paperback format and the number of copies printed will not exceed 4,000. It will sell at the unit cost of approximately $18.95. On November 16, 1995, the Board granted a non-exclusive licence authorizing the applicants to reproduce the articles described above. In its reasons for the decision dated January 19, 1996, the Board was satisfied that the applicants had made the reasonable efforts, in the circumstances, to locate the copyright owners. The Board applies the same reasons in the case at hand since the copyright owners are the same for whom a licence was delivered earlier. Consequently, the Board grants a non-exclusive licence authorizing the applicants to reproduce the articles described above. Pursuant to subsection 70.7(2) of the Copyright Act, the Board establishes the following terms and conditions: A) The expiry date of the licence The licence will expire on March 31, 1997. The authorized reproduction must therefore be completed by that date. B) The type of use authorized The Board authorizes the applicants to reproduce, in no more than 4,000 copies, the articles described above. v) «Oasis on the Roof» par Frances Steinhoff Sanders, publié dans Canadian Homes and Gardens, éd. La Commission a déjà émis le 16 novembre 1995 une licence non exclusive aux requérantes autorisant la reproduction des articles décrits ci-dessus. Dans ses motifs de décision datée du 19 janvier 1996, la Commission a estimé que les requérantes avaient fait leur possible, dans les circonstances, pour retracer les titulaires de droits. La Commission applique les mêmes motifs à la présente requête étant donné que les titulaires de droits sont les mêmes que ceux pour lesquels une licence fut émise le 16 novembre 1995. En conséquence, la Commission émet une licence non exclusive aux requérantes les autorisant à reproduire les articles décrits ci-dessus. Conformément au paragraphe 70.7(2) de la Loi sur le droit d'auteur, voici les modalités établies par la Commission : A) La date d'expiration de la licence La licence expire le 31 mars 1997. On devra donc procéder à toute reproduction autorisée d'ici cette date. B) Le genre d'utilisation autorisée La Commission autorise les requérantes à reproduire, dans au plus 4 000 exemplaires, les articles décrits ci-dessus.
- 3 C) The licence fee After consulting the Canadian Copyright Licensing Agency (CANCOPY), the Board finds it appropriate that the licence fee be set at $300, as follows: ! Dorothy Perkins: nil * ! Claudette Burton: $100 ! Holland Cox: nil * ! Jean McKinley: $75 ! Frances Steinhoff Sanders: $25 ! Carol Stairs: $100 ! Frederick G. Todd: nil * (* CANCOPY did not allocate a value in this instance) D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 70.7(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, it may dispose of the amount of the royalties established in the licence as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before March 31, 2002, ownership of the copyright of any work covered by this licence. Thus, the Board orders that the sum provided for by the licence be paid to CANCOPY. Todd : nil * (* CANCOPY n’a pas attribué de valeur dans ce cas-ci) D) La détention des fonds et la disposition des fonds non réclamés La Commission est d'avis que le pouvoir dont elle dispose en vertu du paragraphe 70.7(2) de la Loi sur le droit d'auteur pour établir les «modalités» de la licence permet d'avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d'auteur introuvables sans imposer un fardeau démesuré au requérant. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d'auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d'auteur pourra ainsi s'adresser à la société de gestion plutôt que d'avoir à s'adresser aux tribunaux. Quant à la société de gestion, elle peut disposer du montant des droits fixés par la licence dans l’intérêt général de ses membres. Elle s’engage toutefois à rembourser toute personne qui établirait, avant le 31 mars 2002, qu’elle détient le droit d’auteur sur toute œuvre faisant l’objet de la présente licence. À cet effet, la Commission ordonne que la somme prévue par la licence soit versée à CANCOPY.
