Copyright Board Commission du droit d’auteur Canada Canada Ottawa, October 31, 1997 FILE: 1997-UO/TI-11 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to The May Street Group Film, Video & Animation Ltd., authorizing the reproduction and incorporation of two newspaper articles in a documentary film REASONS FOR THE DECISION On April 3, 1997, The May Street Group Film, Video & Animation Ltd., Victoria, B.C., filed a licence application with the Board under section 70.7 of the Copyright Act, to reproduce two newspaper articles for incorporation in a documentary film. The articles entitled Where Abortions are Made Easier and Legal Abortions in a Buffalo Doctor’s Office were written by John Gillespie and published in the Globe & Mail newspaper on or about June 24 and June 25, 1971. The applicant wants to incorporate both articles in the documentary film entitled “ANNE ROSS: Rebel with a Cause”. The cinematographic images of the articles will each be approximately 5 seconds in duration and used as visual elements to support voice over narration in the film. In the application, The May Street Group Film, Video & Animation described the efforts made to locate the copyright owner. The applicant first communicated with the Globe & Mail newspaper who said the writer would have to be contacted directly as he was the copyright owner of the articles in question. The applicant undertook to call the 91 Gillespie listed in the Winnipeg telephone book, without any positive result. Cette demande visait la reproduction et l’incorporation de deux articles de journaux dans un film documentaire. Les articles de journaux intitulés Where Abortions are Made Easier et Legal Abortions in a Buffalo Doctor’s Office ont été écrits par John Gillespie et publiés dans le quotidien Globe & Mail le ou dans les environs du 24 et 25 juin 1971. La requérante veut incorporer ces deux articles dans un film documentaire intitulé «ANNE ROSS: Rebel with a Cause». Les images cinématographiques des articles dureront approximativement 5 secondes chacune et serviront d’éléments visuels à l’appui de la narration vocale dans le film. Dans la demande, la requérante a décrit les efforts afin de retrouver le titulaire de droits. The May Street Group Film, Video & Animation a d’abord communiqué avec le journal Globe & Mail qui lui a dit devoir communiquer avec l’auteur directement, ce dernier étant le titulaire des droits des articles en question. La requérante a alors entrepris de téléphoner les 91 Gillespie qui se trouvaient dans le bottin téléphonique de Winnipeg. Ceci n’a donné aucun résultat. La requérante s’est alors adressée
- 2 contacted various libraries and associations in Winnipeg and in the province of Manitoba; none had knowledge of the whereabouts of the author. The Board was satisfied that the applicant made reasonable efforts to locate the copyright owner. Thus, the Board granted on August 25, 1997, a non-exclusive licence authorizing the applicant to reproduce and incorporate the works described above. Pursuant to subsection 77(2) of the Copyright Act, the Board established the following terms and conditions: A) The expiry date of the licence The licence is for a period of five years and expires on September 1, 2002. B) The type of use which is authorized The Board authorizes the applicant to reproduce and incorporate the two articles described above. It also authorizes the public performance or the communication to the public by telecommunication of the articles so incorporated, as part of the exploitation of the documentary film in all Canadian markets. The sole use of the articles will be on film and video, and the articles will not be reproduced in a derivative form. C) The licence fee Since there are no collectives in Canada in the field of audio-visual, the Board consulted the Canadian Copyright Licensing Agency (CANCOPY). They proposed, “without creating a future precedent” a fee of $250 per article. CANCOPY also suggested that the licence make a mention to the effect that “the sole use of the articles will be on film and video, and that they will not be reproduced in a derivative form”. The Board agreed to CANCOPY’s suggestion; it has also found it appropriate that the licence fee be set at $250 per article, for a total of $500. auprès de plusieurs bibliothèques et organismes de Winnipeg puisque l’auteur, John Gillespie, avait aussi écrit et publié plusieurs articles dans le Winnipeg Tribune. Personne ne savait où se trouve l’auteur recherché. La Commission a estimé que la requérante a fait son possible, dans les circonstances, pour retracer le titulaire de droit. En conséquence, la Commission a délivré le 25 août 1997, une licence non exclusive à la requérante l’autorisant à reproduire et incorporer les œuvres décrites ci-dessus. Conformément au paragraphe 77(2) de la Loi sur le droit d’auteur, voici les modalités établies par la Commission : A) La date d’expiration de la licence La licence est pour une période de cinq ans et expire le 1 er septembre 2002. B) Le genre d’utilisation autorisée La Commission autorise la requérante à reproduire et incorporer les deux articles décrits ci-dessus. Elle autorise aussi l’exécution en public ou la communication au public par télécommunication des articles ainsi incorporés, comme partie de l’exploitation du film documentaire destiné aux marchés canadiens. La Commission autorise seulement l’utilisation de ces articles sur film et vidéo; les œuvres ne devront donc pas être reproduites sous aucune autre forme. C) Le coût de la licence Puisqu’il n’existe aucune société de gestion collective au Canada dans le domaine de l’audio-visuel, la Commission a consulté la Canadian Copyright Licensing Agency (CANCOPY) qui a proposé «sans vouloir créer un précédent pour l’avenir» un taux de 250 $ par article. CANCOPY a aussi suggéré que la licence stipule que «l’utilisation des articles se limite aux films et vidéos et qu’ils ne soient pas reproduits sous une autre forme». La Commission a tenu compte de cette suggestion; elle a aussi estimé approprié de fixer à 250 $ par article les droits de licence à payer, soit un total de 500 $.
- 3 D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 77(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant. By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, it may dispose of the amount of the royalties established in the license as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before September 1, 2007, ownership of the copyright of the works covered by this licence. Thus, the Board orders that the sum provided for by the licence be paid to CANCOPY. Le secrétaire de la Commission, Claude Majeau Secretary to the BoardD) La détention des fonds et la disposition des fonds non réclamés La Commission est d’avis que le pouvoir dont elle dispose en vertu du paragraphe 77(2) de la Loi sur le droit d’auteur pour établir les «modalités» de la licence permet d’avoir recours à tout moyen permettant de protéger les intérêts des titulaires de droits d’auteur introuvables sans imposer un fardeau démesuré au requérant. La Commission, en ordonnant de verser les droits fixés par la licence directement à une société de gestion, permet au titulaire des droits d’auteur de pouvoir recouvrer ses droits directement de la société de gestion. Le titulaire des droits d’auteur pourra ainsi s’adresser à la société de gestion plutôt que d’avoir à s’adresser aux tribunaux. Quant à la société de gestion, elle peut disposer du montant des droits fixés par la licence comme bon lui semble pour le bénéfice général de ses membres. Elle s’engage toutefois à rembourser toute personne qui établirait, avant le 1 er septembre 2007, qu’elle détient le droit d’auteur sur les œuvres faisant l’objet de la présente licence. À cet effet, la Commission ordonne que la somme prévue par la licence soit versée à CANCOPY.
