Reasons for the Order On 15 May 1991, Royal Canadian Artillery Museum (herinafter, "the Museum"), Canadian Forces Base Shilo, Manitoba, filed a licence application with the Board under section 70.7 of the Copyright Act (hereinafter, "the Act") to authorize the reproduction of extracts from a book entitled "Canada's V.C.'s" by George C. Machum, published by McClelland and Stewart in 1956. The Museum is a non-profit institution with a mandate to further public understanding of the Canadian military. The Museum is primarily funded by the Royal Canadian Artillery Regimental Fund. It is also funded by the Department of National Defence. The application is made for the purpose of using extracts from 28 pages of this book in producing bibliographical information on 13 Manitoba recipients of the Victoria Cross. This information will be displayed on 16 panels that will form part of an exhibit on Victoria Cross recipients from Manitoba. The exhibit will be presented at approximately 15 locations in Manitoba, over a period of two years. Afterwards, it will become a permanent display at the Museum. The applicant contends that the copyright owner is unlocatable. Motifs de l'ordonnance Le 15 mai 1991, Royal Canadian Artillery Museum (ci-après, "le Musée"), situé à la Base des forces canadiennes Shilo (Manitoba) a déposé une demande de licence auprès de la Commission en vertu de l'article 70.7 de la Loi sur le droit d'auteur (ci-après, "la Loi") autorisant la reproduction d'extraits d'un livre intitulé "Canada's V.C.'s", de George C. - 2 copyright owner are described in the licence application which bears the signature of Major J.C.A. Sawicki, Regimental Major for the Museum. Major Sawicki states that the publisher, McClelland and Stewart, informed him that it was not the copyright owner and was unaware of the identity of the copyright owner. Information gathered from the Department of National Defence indicated that both the author, Mr. Machum, and his wife were no longer living. Mr. Machum passed away in 1958, his wife in 1974. The Department also provided the name of the estate officer for the author's widow, with whom Major Sawicki spoke. However, the officer stated that his records of the estate settlement had been destroyed and that he did not recall any pertinent details. Other efforts, all in vain, made by Major Sawicki to locate the copyright owner include contacting the Department of Veterans Affairs and a magazine for which Mr. Machum had written articles in the 1950s, shortly before his death. The Board is satisfied that the applicant has made reasonable efforts to locate the copyright owner and that, furthermore, the owner cannot be located. Thus, under subsection 70.7(1) of the Act, the Board is entitled to grant a non-exclusive licence authorizing the applicant to use the work described above. Pursuant to subsection 70.7(2), the Board establishes the following terms and conditions: A) The expiry date of the licence. The licence will expire on 1 November 1991. The applicant must therefore complete the authorized reproduction by that date. B) The type of use which is authorized. La Commission estime que le demandeur a fait son possible, dans les circonstances, pour essayer de trouver le titulaire du droit d'auteur et que, par ailleurs, celui-ci est introuvable. Pour ce motif, le paragraphe 70.7(1) de la Loi permet à la Commission d'émettre une licence non exclusive au demandeur l'autorisant à utiliser l'oeuvre décrite ci-haut. Conformément au paragraphe 70.7(2), voici les modalités que fixe la Commission: A) La date d'expiration de la licence. La licence expire le 1 er novembre 1991. Le demandeur doit donc compléter la reproduction autorisée d'ici cette date. B) Le genre d'utilisation autorisée. La Commission autorise le demandeur à

The Board notes that no more than 28 pages are to be used, no more than one copy of these pages is to be made, and that the applicant will not be gaining any material benefit from this licence, especially as there will be no entrance fee charged for the exhibit in which the extracts to be reproduced will be displayed. D) The holding of funds and the disposal of unclaimed funds. Subsection 70.7(3) of the Act indicates that unlocatable copyright owners "may, not later, than five years after the expiration of a licence (...) collect the royalties fixed in the licence". The applicant shall therefore be required to pay the amount of the royalties set by this licence, $25.00, to the copyright owner should that owner present a claim no later than 31 October 1996. La Commission estime appropriée de fixer à 25,00$ les droits de licence à payer dans les circonstances. En effet, seulement 28 pages de l'oeuvre seront utilisées, une seule copie sera faite et aucun gain matériel ne sera tiré de l'utilisation de la reproduction permise par cette licence, notamment sous forme de droits d'entrée à l'exposition où les extraits de l'oeuvre seront présentés. D) La détention des fonds et la disposition des fonds non réclamés. Le paragraphe 70.7(3) de la Loi indique que lorsque la Commission accorde une licence, le titulaire du droit d'auteur "peut percevoir les droits fixés pour la licence (...) jusqu'à cinq ans après l'expiration de la licence". Le demandeur devra donc verser au titulaire du droit d'auteur le montant des droits fixés par cette licence, soit 25,00$, si celui-ci présente une demande à cet effet au plus tard le 31 octobre 1996.
