Copyright Board Commission du droit d’auteur Canada Canada Ottawa, January 14, 1998 FILE: 1997-UO/TI-19 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Kitchen Sink Entertainment Inc., authorizing the reproduction and incorporation of a magazine article in a documentary film REASONS FOR THE DECISION On October 21, 1997, Ms. Daegan Fryklind, Production Assistant, Kitchen Sink Entertainment Inc., Vancouver, B.C., filed a licence application with the Board under subsection 77(1) of the Copyright Act , to reproduce a magazine article for incorporation in a documentary film. The article entitled Going Back to Work was written by Sheila Ward and published in the September 1960 issue of the Chatelaine Magazine. The applicant wants to incorporate the article in the documentary film entitled “The Vanishing Housewife”. The cinematographic image of a quote of the article will last no more than 30 seconds in the 47 minutes documentary film. In the application, Ms. Fryklind described the efforts made to locate the copyright owner. She first communicated with the Chatelaine Magazine who did a thorough search but to no avail. Ms. Fryklind then contacted the Periodical Writers Association and the Writers Union of Canada; none had knowledge of this author. She also undertook a search on the 411 Internet Directory but was unable to locate Sheila Ward.
- 2 The Board is satisfied that the applicant made the reasonable efforts, in the circumstances, to locate the copyright owner. Thus, the Board grants a non-exclusive licence authorizing the applicant to reproduce and incorporate the work described above. Pursuant to subsection 77(2) of the Copyright Act, the Board established the following terms and conditions: A) The expiry date of the licence The licence is for a period of five years and expires on December 31, 2002. B) The type of use authorized The Board authorizes the applicant to reproduce and incorporate the article described above. It also authorizes the public performance or the communication to the public by telecommunication of the article so incorporated, as part of the exploitation of the documentary film, in all Canadian markets. The sole use of the article will be on film and video and the article will not be reproduced in any derivative form or otherwise. C) The licence fee Since there are no collecting society in Canada in the field of audio-visual, the Board consulted the Canadian Copyright Licensing Agency (CANCOPY). They proposed, “without creating a future precedent” a fee of $150. CANCOPY also suggested that the licence make a mention to the effect that “the sole use of the article will be on film and video, and that it will not be reproduced in a derivative form or otherwise”. The Board agreed to CANCOPY’s suggestion; it has also found it appropriate that the licence fee be set at $150. D) The holding of funds and the disposal of unclaimed funds The Board is of the view that its power under subsection 77(2) of the Copyright Act to establish the "terms and conditions" of a licence allows it to use any means that will protect the interests of unlocatable copyright owners without imposing an undue burden on the applicant.
- 3 By ordering payment of the royalties fixed by the licence directly to a licensing body, the Board makes it possible for the copyright owner to recover these royalties directly from the licensing body. The copyright owner will thus be able to approach the licensing body, rather than approaching the courts. As for the licensing body, it may dispose of the amount of the royalties established in the license as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before December 31, 2007, ownership of the copyright of the works covered by this licence. Thus, the Board orders that the sum provided for by the licence be paid to CANCOPY.
